S T A T E O F N E W Y O R K ________________________________________________________________________ 5414 2025-2026 Regular Sessions I N A S S E M B L Y February 13, 2025 ___________ Introduced by M. of A. GIBBS -- read once and referred to the Committee on Judiciary AN ACT to amend the judiciary law, in relation to removing the lifetime ban on jury duty for convicted felons; and to repeal certain provisions of such law related thereto THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 510 of the judiciary law is REPEALED. § 2. Section 517 of the judiciary law is amended by adding a new subdivision (d) to read as follows: (D) THE JURY SERVICE OF ANY PERSON SERVING A TERM OF INCARCERATION FOR A FELONY CONVICTION SHALL BE POSTPONED WHILE THE PERSON IS INCARCERATED FOR SUCH FELONY. § 3. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD05843-03-5

Section 510 of the judiciary law, as amended by chapter 86 of the laws of 1995, is amended to read as follows: § 510. Qualifications. [In order to] TO qualify as a juror, a person must: 1. Be a citizen of the United States, and a resident of the county. 2. Be not less than eighteen years of age. 3. [Not have been convicted of a felony. 4.] Be able to understand and communicate in the English language. § 2. Section 517 of the judiciary law is amended by adding a new subdivision (d) to read as follows: (D) THE JURY SERVICE OF ANY PERSON SERVING A TERM OF INCARCERATION FOR A FELONY CONVICTION SHALL BE EXCUSED WHILE THE PERSON IS INCARCERATED FOR SUCH FELONY. § 3.
