 AN ACT to amend the  environmental  conservation  law,  in  relation  to
   requiring  the  commissioner  of  environmental  conservation to place
   certain air quality monitoring systems within a one-mile radius of all
   airports located within a city having a population of one  million  or
   more
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The environmental conservation law is amended by  adding  a
 new section 19-0322 to read as follows:
 §  19-0322.  AIR  QUALITY  MONITORING SYSTEMS REQUIRED WITHIN A ONE-MILE
              RADIUS OF ALL AIRPORTS WITHIN A CITY HAVING A POPULATION OF
              ONE MILLION OR MORE.
   1. THE COMMISSIONER SHALL PLACE AND OPERATE  AN  AMBIENT  AIR  QUALITY
 MONITOR  NETWORK  WITHIN  A  ONE-MILE  RADIUS  OF ALL AIRPORTS IN CITIES
 HAVING A POPULATION OF ONE MILLION OR MORE. THE  NETWORK  SHALL  CONTIN-
 UOUSLY  MEASURE  DATA  FOR  OZONE,  SULFUR  DIOXIDE, OXIDES OF NITROGEN,
 CARBON DIOXIDE, METEOROLOGICAL DATA, PM 1.0  AND  PM  2.5.  THE  NETWORK
 SHALL ALSO INCLUDE AN AUTOMATED DATA ACQUISITION SYSTEM EMPLOYED TO POLL
 THE  SITES  TO  RETRIEVE READINGS INTO A CENTRAL DATA MANAGEMENT SYSTEM.
 THE DATA SHALL UNDERGO VERIFICATION AND VALIDATION BY A SUPERVISING SITE
 ENGINEER WHICH SHALL FOLLOW ESTABLISHED QUALITY  ASSURANCE  AND  QUALITY
 CONTROL PROCEDURES.
   2. THE COMMISSIONER SHALL PLACE AND OPERATE A PHOTOCHEMICAL ASSESSMENT
 MONITORING  STATION  AND A NATIONAL AMBIENT TOXIC TREND STATION WITHIN A
 ONE-MILE RADIUS OF ALL AIRPORTS LOCATED WITHIN A  CITY  HAVING  A  POPU-
 LATION  OF  ONE  MILLION  OR  MORE. SUCH STATIONS SHALL MONITOR VOLATILE
 ORGANIC COMPOUNDS AS OZONE PRECURSORS DURING THE SUMMER OZONE SEASON FOR
 THE PURPOSE OF DETERMINING THE QUALITY OF  AMBIENT  AIR  AND  DEVELOPING
 PROGRAMS TO TARGET APPROPRIATE SOURCE CATEGORIES FOR EMISSION REDUCTION.

   BRAUNSTEIN,  ZACCARO, HYNDMAN, FALL, KASSAY, MITAYNES -- read once and
   referred to the Committee on Environmental Conservation -- recommitted
   to the Committee on  Environmental  Conservation  in  accordance  with
   Assembly Rule 3, sec. 2 -- committee discharged, bill amended, ordered
   reprinted as amended and recommitted to said committee
 
 AN  ACT  to  amend  the  environmental  conservation law, in relation to
   requiring the department of  environmental  conservation  to  place  a
   community air monitoring system and similar systems as necessary with-
   in  a  one-mile  radius of all airports located within a city having a
   population of one million or more
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The environmental conservation law is amended by adding a
 new section 19-0322 to read as follows:
 § 19-0322. AIR QUALITY MONITORING SYSTEMS  REQUIRED  WITHIN  A  ONE-MILE
              RADIUS OF ALL AIRPORTS WITHIN A CITY HAVING A POPULATION OF
              ONE MILLION OR MORE.
   1.  THE  DEPARTMENT SHALL PLACE AND OPERATE A COMMUNITY AIR MONITORING
 SYSTEM AS DEFINED IN SECTION 75-0115 OF THIS CHAPTER, AND ANY OTHER  AIR
 QUALITY  OR  PHOTOCHEMICAL ASSESSMENT MONITORING EQUIPMENT DEEMED NECES-
 SARY TO MONITOR TOXIC AIR CONTAMINANTS AND CRITERIA AIR POLLUTANTS WITH-
 IN A ONE-MILE RADIUS OF ALL AIRPORTS IN CITIES HAVING  A  POPULATION  OF
 ONE MILLION OR MORE.  THE DEPARTMENT SHALL TIMELY PUBLISH THE AIR QUALI-
 TY DATA PRODUCED BY SUCH SYSTEMS ON ITS WEBSITE AS IT BECOMES AVAILABLE.
   2.  THE  COMMISSIONER  OR  COMMISSIONER'S REPRESENTATIVE SHALL PERIOD-
 ICALLY MEET WITH LOCAL COMMUNITY  ORGANIZATIONS  AND  ELECTED  OFFICIALS
 REPRESENTING  THE  AREA  IN  WHICH AN AIRPORT MONITORED PURSUANT TO THIS
 SECTION IS LOCATED, TO INFORM THEM OF THE RESULTS  OF  THE  AIR  QUALITY
 MONITORING.
   §  2. This act shall take effect on the first of April next succeeding
 the date on which it shall have become a law.
