AN ACT to amend the parks, recreation and historic preservation law, in
relation to requiring sunscreen be made available at all state parks,
recreational facilities, historic sites or programs and other appro-
priate locations
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivision 21 of section 3.09 of the parks, recreation and
historic preservation law, as added by chapter 338 of the laws of 2005,
is amended to read as follows:
21. (A) Develop, in consultation with the commissioner of health,
informational signs and brochures alerting patrons of the dangers of
overexposure to the sun and its relationship to skin cancer. The infor-
mation on such signs and in such brochures shall include methods by
which an individual may help prevent exposure to the sun and lessen [his
or her] SUCH INDIVIDUAL'S risk of contracting skin cancer. Such signs
and informational brochures shall be placed in appropriate locations at
the discretion of the commissioner.
(B) MAKE SUNSCREEN AVAILABLE AT THE ENTRANCE TO ALL STATE PARKS,
RECREATIONAL FACILITIES, HISTORIC SITES OR PROGRAMS AND OTHER APPROPRI-
ATE LOCATIONS AT THE DISCRETION OF THE COMMISSIONER. FOR THE PURPOSES OF
THIS SUBDIVISION, THE TERM "SUNSCREEN" SHALL MEAN ANY TOPICAL SUNSCREEN
PRODUCT APPROVED BY THE FEDERAL FOOD AND DRUG ADMINISTRATION FOR OVER-
THE-COUNTER USE FOR THE PURPOSE OF AVOIDING OVEREXPOSURE TO THE SUN AND
NOT FOR MEDICAL TREATMENT OF AN INJURY OR ILLNESS.
§ 2. This act shall take effect on the one hundred twentieth day after
it shall have become a law; provided, however, that effective immediate-
ly, the addition, amendment and/or repeal of any rules or regulations
necessary for the implementation of the foregoing provisions of this act
on its effective date are authorized and directed to be made and
completed on or before such effective date.
