WOERNER -- read once and referred to the Commit- tee on Labor AN ACT to amend the general business law, in relation to exempting payroll agencies from the definition of hiring party for certain purposes THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 4 of section 1410 of the general business law, as added by chapter 98 of the laws of 2024, is amended to read as follows: 4. (A) "Hiring party" means any person who retains a freelance worker to provide any service, other than: [(a)] (I) the United States government; [(b)] (II) the state of New York, including any office, department, agency, authority or other body of the state including the legislature and the judiciary; [(c)] (III) a municipality, including any office, department, agency or other body of a municipality; or [(d)] (IV) any foreign government. (B) FOR THE PURPOSE OF THIS ARTICLE, THE TERM "HIRING PARTY" SHALL NOT INCLUDE A PAYROLL AGENCY THAT PROVIDES PAYROLL SERVICES ON BEHALF OF ANOTHER PERSON OR ORGANIZATION. § 2.
