Expands the offense of aggravated harassment in the first degree to include etching, painting, drawing upon or otherwise placing or displaying emblems, logos, flags or other symbols of designated terrorist organizations on any building or other real property without express permission of the owner or operator of such building or real property.

 AN  ACT  to  amend  the  penal  law, in relation to enacting the "SAFETY
   (Stand Against Flags of Enemy Terrorists) act"
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1.  Short  title. This act shall be known and may be cited as
 the "SAFETY (Stand Against Flags of Enemy Terrorists) act".
   § 2. Subdivision 5 of section 240.31 of the penal  law,  as  added  by
 chapter  74  of  the laws of 2008, is amended and a new subdivision 6 is
 added to read as follows:
   5. Etches, paints, draws upon or otherwise places or displays a noose,
 commonly exhibited as a symbol of racism and intimidation, on any build-
 ing or other real property, public or private, owned by any person, firm
 or corporation or any public agency or instrumentality, without  express
 permission   of   the  owner  or  operator  of  such  building  or  real
 property[.]; OR
   6. ETCHES, PAINTS, DRAWS UPON OR OTHERWISE PLACES OR DISPLAYS EMBLEMS,
 LOGOS, FLAGS OR OTHER SYMBOLS OF DESIGNATED FOREIGN TERRORIST  ORGANIZA-
 TIONS,  AS  DEFINED  IN  8  U.S.C. § 1189, ON ANY BUILDING OR OTHER REAL
 PROPERTY, PUBLIC OR PRIVATE, OWNED BY ANY PERSON, FIRM OR CORPORATION OR
 ANY PUBLIC AGENCY OR INSTRUMENTALITY, WITHOUT EXPRESS PERMISSION OF  THE
 OWNER OR OPERATOR OF SUCH BUILDING OR REAL PROPERTY.
   §  3.  This  act shall take effect on the ninetieth day after it shall
 have become a law.
