S T A T E O F N E W Y O R K ________________________________________________________________________ 7889 2025-2026 Regular Sessions I N A S S E M B L Y April 11, 2025 ___________ Introduced by M. of A. KAY -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to the provision of transportation after 4pm by school districts in Sullivan county THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 3627-a to read as follows: § 3627-A. TRANSPORTATION AFTER 4PM FOR SULLIVAN COUNTY. 1. NOTWITH- STANDING ANY OTHER PROVISIONS OF THIS SECTION TO THE CONTRARY, FOR THE TWO THOUSAND TWENTY-FIVE--TWO THOUSAND TWENTY-SIX SCHOOL YEAR AND THERE- AFTER, EVERY SCHOOL DISTRICT LOCATED IN THE COUNTY OF SULLIVAN PROVIDING TRANSPORTATION PURSUANT TO THIS CHAPTER SHALL BE RESPONSIBLE FOR: (A) (I) PROVIDING TRANSPORTATION FOR EVERY CHILD ATTENDING A PUBLIC OR NONPUBLIC SCHOOL WHO RESIDES IN AN AREA CONTAINING AT LEAST FIFTY CHIL- DREN WITHIN A FIVE MILE RADIUS WHO REMAINS AT THE SAME SCHOOL FOR WHICH THEY ARE ENROLLED FOR REGULARLY SCHEDULED ACADEMIC CLASSES FROM HALF- PAST NINE O'CLOCK IN THE MORNING OR EARLIER UNTIL FOUR O'CLOCK IN THE AFTERNOON OR LATER, ON WEEKDAYS; (II) SUCH TRANSPORTATION SHALL BE PROVIDED TO ALL CHILDREN ATTENDING GRADES KINDERGARTEN THROUGH EIGHT WHO LIVE MORE THAN TWO MILES FROM THE SCHOOL, WHICH THEY LEGALLY ATTEND, AND FOR ALL CHILDREN ATTENDING GRADES NINE THROUGH TWELVE WHO LIVE MORE THAN THREE MILES FROM THE SCHOOL WHICH THEY LEGALLY ATTEND, AND SHALL BE PROVIDED FOR EACH SUCH PUPIL UP TO A DISTANCE OF FIFTEEN MILES, THE DISTANCES IN EACH CASE BEING MEASURED BY THE NEAREST AVAILABLE ROUTE FROM SUCH CHILD'S HOME TO SCHOOL; OR (B) REIMBURSING THE COST INCURRED BY LICENSED TRANSPORTATION CARRIERS PURSUANT TO CONTRACTS WITH SUCH SCHOOL DISTRICT FOR PROVIDING TRANSPOR- TATION FOR THOSE CHILDREN ATTENDING PUBLIC AND NONPUBLIC SCHOOLS ATTEND- ING GRADES KINDERGARTEN THROUGH EIGHT WHO LIVE MORE THAN TWO MILES FROM THE SCHOOL, WHICH THEY LEGALLY ATTEND, AND FOR ALL CHILDREN ATTENDING EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
