PEOPLES-STOKES -- read once and referred to the Committee on Higher Education AN ACT to amend the education law, in relation to authorizing the appli- cation of topical fluoride varnish to a child's teeth by a parent or legal guardian THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 6610 of the education law is amended by adding a new subdivision 9 to read as follows: 9. THE APPLICATION OF TOPICAL FLUORIDE VARNISH TO A CHILD'S TEETH BY SUCH CHILD'S PARENT OR LEGAL GUARDIAN, PROVIDED THAT SUCH APPLICATION IS DONE UNDER THE DIRECTION AND SUPERVISION OF A LICENSED PRACTITIONER AUTHORIZED TO APPLY TOPICAL FLUORIDE VARNISH. A LICENSED PRACTITIONER ACTING WITHIN THEIR SCOPE OF PRACTICE MAY PRESCRIBE TOPICAL FLUORIDE VARNISH FOR THE PURPOSES OF THIS SUBDIVISION PROVIDED THAT SUCH PRACTI- TIONER DISPENSES WRITTEN SAFETY INSTRUCTIONS TO THE PARENT OR LEGAL GUARDIAN. § 2.
