 AN ACT to amend the transportation law, in relation to third-party iden-
   tity verification service reporting
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1.  The transportation law is amended by adding a new section
 14-o to read as follows:
   § 14-O. THIRD-PARTY IDENTITY VERIFICATION SERVICE REPORTING. 1.    FOR
 PURPOSES  OF  THIS SECTION, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING
 MEANINGS:
   (A) "THIRD-PARTY IDENTIFICATION VERIFICATION  SERVICE"  SHALL  MEAN  A
 PRIVATELY OPERATED IDENTITY VERIFICATION SERVICE THAT UTILIZES BIOMETRIC
 DATA,  INCLUDING  BUT NOT LIMITED TO FINGERPRINT AND FACIAL RECOGNITION,
 AND SECURE CREDENTIALING TO CONFIRM THE IDENTITY OF INDIVIDUALS FOR  THE
 PURPOSE  OF  FACILITATING EXPEDITED ACCESS TO DESIGNATED SECURITY CHECK-
 POINTS AT PUBLIC-USE AIRPORTS.
   (B) "PUBLIC-USE AIRPORT" SHALL MEAN AN AIRPORT AVAILABLE  FOR  USE  BY
 THE  GENERAL  PUBLIC WITHOUT A REQUIREMENT FOR THE PRIOR APPROVAL OF THE
 OWNER OR OPERATOR THEREOF EXCEPT AS MAY BE REQUIRED BY  FEDERAL  LAW  OR
 REGULATION.
   (C)  "SECURITY  BREACH"  SHALL  MEAN  ANY INSTANCE WHERE AN INDIVIDUAL
 PASSES THROUGH A SECURITY CHECKPOINT SUCCESSFULLY WHILE  TRANSPORTING  A
 RESTRICTED ITEM, INCLUDING BUT NOT LIMITED TO A CONCEALED WEAPON.
   2.  EACH  THIRD-PARTY IDENTIFICATION VERIFICATION SERVICE OPERATING IN
 THE STATE SHALL, ON A QUARTERLY BASIS, PROVIDE  TO  THE  DEPARTMENT  THE
 FOLLOWING INFORMATION:
   (A)  THE NUMBER OF AIRLINE PASSENGERS WHO USED A THIRD-PARTY IDENTIFI-
 CATION VERIFICATION SERVICE  FOR  THE  PURPOSE  OF  RECEIVING  EXPEDITED
 ACCESS  THROUGH  A  SECURITY  CHECKPOINT  AT A PUBLIC-USE AIRPORT IN THE
 STATE;
