 AN ACT to amend the correction law, in relation to  requiring  discipli-
   nary hearings for incarcerated individuals to be recorded
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The correction law is amended by adding a new section 137-a
 to read as follows:
   § 137-A. DISCIPLINARY HEARINGS TO BE RECORDED.  THE  DEPARTMENT  SHALL
 ENSURE THAT EVERY INCARCERATED INDIVIDUAL DISCIPLINARY HEARING HELD AT A
 CORRECTIONAL  FACILITY  SHALL  BE  RECORDED  WITH  BOTH AUDIO AND VISUAL
 COMPONENTS. THE DEPARTMENT SHALL MAINTAIN AND PRESERVE  THE  FULL  AUDIO
 AND  VIDEO RECORDING AND SHALL ADD SUCH RECORDINGS TO THE SUBJECT INCAR-
 CERATED INDIVIDUAL'S FILE WITHIN THE DEPARTMENT'S DATABASE. THE  COMMIS-
 SIONER  SHALL  PROMULGATE  RULES  AND REGULATIONS TO ALLOW FOR ACCESS TO
 SUCH AUDIO AND VIDEO RECORDINGS, INCLUDING BUT NOT LIMITED TO WHEN  SUCH
 AUDIO  AND  VIDEO RECORDINGS CAN BE ACCESSED, AND BY WHOM SUCH AUDIO AND
 VIDEO RECORDINGS CAN BE ACCESSED BY.
   § 2. This act shall take effect immediately.
