S T A T E O F N E W Y O R K ________________________________________________________________________ 8460 2025-2026 Regular Sessions I N A S S E M B L Y May 16, 2025 ___________ Introduced by M. of A. CUNNINGHAM -- read once and referred to the Committee on Health AN ACT to amend the general business law, in relation to prohibiting hospitals and health care providers from storing credit card informa- tion without consent THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 519-a of the general business law is amended by adding a new subdivision 4 to read as follows: 4. NO HOSPITAL OR HEALTH CARE PROVIDER SHALL KEEP A CREDIT CARD ON FILE WITHOUT OBTAINING WRITTEN CONSENT IN THE FORM OF A SIGNATURE FROM THE PATIENT. PATIENTS SHALL BE ADVISED IN WRITING, USING TWELVE-POINT FONT OR LARGER, AT THE TIME OF PAYING FOR ANY SERVICES WITH A CREDIT CARD IF THE CREDIT CARD INFORMATION WILL BE KEPT ON FILE AND IF SUCH CREDIT CARD INFORMATION WILL BE USED TO PAY ANY BALANCES ON THE ACCOUNT. § 2. This act shall take effect on the ninetieth day after it shall have become a law. Effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized to be made and completed on or before such effective date.
