CLARK -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to directing school districts to establish parent advisory councils on special education THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 4402 of the education law is amended by adding a new subdivision 10 to read as follows: 10. THE BOARD OF EDUCATION OR TRUSTEES OF EACH SCHOOL DISTRICT SHALL ESTABLISH A PARENT ADVISORY COUNCIL ON SPECIAL EDUCATION. MEMBERSHIP OF SUCH COUNCIL SHALL BE OFFERED TO ALL PARENTS OF CHILDREN WITH DISABILI- TIES IN THE SCHOOL DISTRICT AND OTHER INTERESTED PARTIES. THE PARENT ADVISORY COUNCILS' DUTIES SHALL INCLUDE, BUT NOT BE LIMITED TO, ADVISING THE BOARD OF EDUCATION OR TRUSTEES OF THE SCHOOL DISTRICT ON MATTERS THAT PERTAIN TO THE EDUCATION AND SAFETY OF STUDENTS WITH DISABILITIES, AND MEETING REGULARLY WITH SCHOOL OFFICIALS TO PARTICIPATE IN THE PLAN- NING, DEVELOPMENT, AND EVALUATION OF THE SCHOOL DISTRICT'S SPECIAL EDUCATION PROGRAMS. PARENT ADVISORY COUNCILS SHALL ESTABLISH BY-LAWS REGARDING OFFICERS AND OPERATIONAL PROCEDURES. IN THE COURSE OF ITS DUTIES UNDER THIS SECTION, A PARENT ADVISORY COUNCIL SHALL RECEIVE ASSISTANCE FROM THE BOARD OF EDUCATION OR TRUSTEES WITHOUT CHARGE, UPON REASONABLE NOTICE, AND SUBJECT TO THE AVAILABILITY OF STAFF AND RESOURCES. § 2.
