S T A T E O F N E W Y O R K ________________________________________________________________________ 8644 2025-2026 Regular Sessions I N A S S E M B L Y May 22, 2025 ___________ Introduced by M. of A. MAGNARELLI -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to authorizing certain school districts and their municipalities to authorize a one-time annual increase to the amount of school district expenditures funded by city funds to be excluded from certain calculations THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph b of subdivision 5-b of section 2576 of the education law, as added by section 9 of part B of chapter 57 of the laws of 2007, is amended to read as follows: b. The city amount shall not be less than the city amount appropriated in the base year determined at the time of adoption of the budget for the ensuing fiscal year, and shall not be less than the city amount expended in the base year determined as of the end of the school year. Provided, however, in the event the total amount of city funds relied upon to balance such budget is lower than the total amount of city funds appropriated in the base year, as determined at the time of adoption of such budget, the city amount may be reduced by up to the same percentage as the overall percentage decrease in city funds between the base year and the ensuing fiscal year. NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, A SCHOOL DISTRICT AND SUCH SCHOOL DISTRICT'S RESPECTIVE MUNICIPALITY MAY SIGN A MEMORANDUM OF UNDERSTANDING TO AUTHORIZE A ONE- TIME ANNUAL INCREASE IN THE CITY AMOUNT TO BE EXCLUDED FROM THE MAINTE- NANCE OF EFFORT CALCULATION. SUCH MEMORANDUM OF UNDERSTANDING SHALL BE ADOPTED PRIOR TO THE APPROPRIATION OR TRANSFER OF SUCH FUNDS TO THE SCHOOL DISTRICT. § 2. This act shall take effect immediately.
