BRONSON, CLARK -- read once and referred to the Committee on Health AN ACT to amend the public health law, in relation to reimbursement rates for certain programs established by not-for-profit and public skilled nursing facilities in upstate New York nursing home regions THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2826 of the public health law is amended by adding a new subdivision (h) to read as follows: (H) NOTWITHSTANDING ANY PROVISION OF LAW TO THE CONTRARY, THE COMMIS- SIONER IS AUTHORIZED TO GRANT APPROVAL TO ELIGIBLE PROGRAMS ESTABLISHED BY NOT-FOR-PROFIT AND PUBLIC SKILLED NURSING FACILITIES IN ANY OF THE FIVE NURSING HOME REGIONS IN UPSTATE NEW YORK, WHICH ARE DESIGNED TO WORK COLLABORATIVELY ON EFFORTS TO IMPROVE NURSING HOME EFFICIENCY, STAFFING, AND QUALITY OF CARE. UPON APPLICATION BY THE REGIONAL PROGRAM, THE COMMISSIONER SHALL APPROVE THOSE REGIONS WHICH APPLY FOR SUCH DESIG- NATION WHO CAN DEMONSTRATE, TO THE SATISFACTION OF THE COMMISSIONER, THAT THE PROGRAMS PRESENT A COLLABORATIVE EFFORT DESIGNED TO IMPROVE THE QUALITY OF NURSING HOME CARE AND SERVICES AND THAT APPROPRIATE PROGRAM STRUCTURAL SAFEGUARDS ARE INCLUDED TO PREVENT ANY COLLUSION OR ANTI-COM- PETITIVE PRACTICES. § 2.
