 AN ACT to amend the correction law, in relation to preserving records of
   certain violations in correctional facilities
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1.  Section  112 of the correction law is amended by adding a
 new subdivision 7 to read as follows:
   7. THE COMMISSIONER SHALL PROMULGATE RULES AND REGULATIONS  TO  ESTAB-
 LISH  AND  MAINTAIN  A  SYSTEM  FOR THE PRESERVATION OF DATA ON TIER ONE
 VIOLATIONS IN CORRECTIONAL FACILITIES, WHICH SHALL  BE  KEPT  SEPARATELY
 FROM  AN  INCARCERATED  INDIVIDUAL'S INSTITUTIONAL RECORD, AND SHALL NOT
 PREVENT A CORRECTIONAL FACILITY FROM REMOVING A TIER ONE VIOLATION  FROM
 AN INCARCERATED INDIVIDUAL'S INSTITUTIONAL RECORD.
   § 2. This act shall take effect immediately.
