 AN ACT to amend the education law, in relation to  requiring  a  certain
   type of opioid overdose rescue kit be provided by the state to schools
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 922 of the education law is amended by adding a new
 subdivision 3 to read as follows:
   3. (A) THE COMMISSIONER SHALL PROVIDE TO EVERY ELEMENTARY AND  SECOND-
 ARY  SCHOOL,  PUBLIC  OR  PRIVATE, AND EVERY TRADE OR VOCATIONAL SCHOOL,
 COLLEGE, AND UNIVERSITY, PUBLIC OR PRIVATE, WITHIN THE  STATE  AT  LEAST
 ONE  OPIOID  AND  FENTANYL OVERDOSE RESCUE KIT AT NO COST TO THE SCHOOL.
 TRAINING SHALL BE MADE AVAILABLE, BUT SHALL  NOT  BE  REQUIRED,  TO  ANY
 TEACHER,  FACULTY,  OR  STAFF MEMBER OF SUCH SCHOOLS OR SCHOOL DISTRICTS
 WHO WISHES TO PARTICIPATE IN SUCH TRAINING IN ACCORDANCE  WITH  SUBDIVI-
 SION TWO OF THIS SECTION.
   (B)  FOR  THE PURPOSES OF THIS SUBDIVISION, "OPIOID AND FENTANYL OVER-
 DOSE RESCUE KIT" MEANS A BOX WHICH:
   (I) CONTAINS AT LEAST TWO DOSES OF NALOXONE NASAL SPRAYS AND  CARDIOP-
 ULMONARY RESUSCITATION EQUIPMENT;
   (II) CAN BE WIRELESSLY CONNECTED TO THE INTERNET;
   (III) IS PROGRAMMED TO ALERT FIRST RESPONDERS WHEN SUCH BOX IS OPENED;
 AND
   (IV) IS PROGRAMMED TO PROVIDE WIRELESS NOTIFICATION BEFORE THE EXPIRA-
 TION  DATE  OF THE INCLUDED NALOXONE OR ANY OTHER MEDICATIONS OR PERISH-
 ABLE SUPPLIES.
   § 2. This act shall take effect on the ninetieth day  after  it  shall
 have become a law. Effective immediately, the addition, amendment and/or
 repeal  of  any  rule  or regulation necessary for the implementation of
 this act on its effective date are authorized to be made  and  completed
 on or before such effective date.
