S T A T E O F N E W Y O R K ________________________________________________________________________ 8873 2025-2026 Regular Sessions I N A S S E M B L Y June 9, 2025 ___________ Introduced by M. of A. ANDERSON -- read once and referred to the Commit- tee on Local Governments AN ACT to amend the general municipal law, in relation to requiring municipal corporations to reimburse residents for the justifiable maintenance of publicly owned areas THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general municipal law is amended by adding a new section 137 to read as follows: § 137. JUSTIFIABLE MAINTENANCE OF PUBLICLY OWNED AREAS. EVERY MUNICI- PAL CORPORATION LOCATED WITHIN THE STATE SHALL ESTABLISH A REIMBURSEMENT PROGRAM FOR RESIDENT MAINTENANCE EXPENSES ASSOCIATED WITH PUBLICLY OWNED SIDEWALKS, CURBS AND ADJACENT LANDSCAPED AREAS. FOR PURPOSES OF THIS SECTION, MAINTENANCE SHALL INCLUDE SNOW REMOVAL, THE REMOVAL OF DEBRIS AND ANY OTHER UPKEEP DEEMED JUSTIFIABLE MAINTENANCE BY THE MUNICIPAL CORPORATION. A COMPREHENSIVE LIST OF SUCH JUSTIFIABLE MAINTENANCE SHALL BE PROVIDED TO EACH RESIDENT. EACH MUNICIPAL CORPORATION SHALL ESTABLISH A MECHANISM FOR RESIDENTS TO PROVIDE DOCUMENTATION OF JUSTIFIABLE MAIN- TENANCE EXPENSES. AFTER SUCH DOCUMENTATION IS RECEIVED, THE MUNICIPAL CORPORATION SHALL REIMBURSE SUCH RESIDENTS IN WHOLE OR IN PART FOR ALL ESTABLISHED JUSTIFIABLE MAINTENANCE. § 2.
