McDONALD -- read once and referred to the Commit- tee on Governmental Employees AN ACT to amend the retirement and social security law, in relation to extending the waiver of approval and income limitations on to retired law enforcement officers employed as school resource officers in school districts and board of cooperative educational services THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 9 of section 211 of the retirement and social security law, as added by section 1 of part HH of chapter 56 of the laws of 2022, is amended to read as follows: 9. Notwithstanding the provisions of this section, sections two hundred twelve and four hundred one of this chapter and section five hundred three of the education law and any other law, regulation, rule, local law, or charter to the contrary, a retired person, OR A LAW ENFORCEMENT OFFICER AS DEFINED BY SECTION TWO HUNDRED NINE-V OF THE GENERAL MUNICIPAL LAW, ASSIGNED BY ANY LAW ENFORCEMENT AGENCY AS DEFINED IN SUBDIVISION EIGHT OF SECTION EIGHTY-SIX OF THE PUBLIC OFFICERS LAW, may be employed and earn compensation in a position or positions in the service of a school district or a board of cooperative educational services in the state without any effect on [his or her] THEIR status as retired and without suspension or diminution of [his or her] THEIR retirement allowance and without prior approval pursuant to subdivision two of this section. Earnings received as a result of employment in a school district or a board of cooperative educational services in the state shall not be applied to a retired person's OR LAW ENFORCEMENT OFFICER'S earnings when calculating the earnings limitations imposed by subdivisions one and two of section two hundred twelve of this article. § 2. This act shall take effect immediately; provided, however, that the amendments to subdivision 9 of section 211 of the retirement and social security law made by section one of this act shall not affect the repeal of such subdivision and shall be deemed repealed therewith.
