 AN ACT to amend the real property law, in relation to requiring  certain
   landlords and property managers to provide notice to tenants on proper
   protocols for recycling
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1.  The real property law is amended by adding a  new  section
 235-k to read as follows:
   §  235-K.  RECYCLING PROTOCOLS; NOTICE. 1. THE DIVISION OF HOUSING AND
 COMMUNITY RENEWAL SHALL REQUIRE EACH LANDLORD OR PROPERTY MANAGER  IN  A
 CITY  OF  A MILLION OR MORE OF A PUBLIC OR PRIVATE MULTI-FAMILY BUILDING
 TO ISSUE TO EACH TENANT A NOTICE, ANNUALLY AND UPON  SIGNING  OF  A  NEW
 LEASE  AND/OR RENEWAL LEASE, TO EDUCATE TENANTS ABOUT THE TYPES OF ITEMS
 THAT ARE REQUIRED TO BE SEPARATED FROM REGULAR TRASH BY STATE  OR  LOCAL
 LAW, RULE, REGULATION OR ORDINANCE. THE DIVISION OF HOUSING AND COMMUNI-
 TY RENEWAL SHALL REQUIRE EACH LANDLORD OR PROPERTY MANAGER TO DISTRIBUTE
 SUCH  NOTICE  TO  ALL TENANTS VIA MAIL OR ELECTRONIC CORRESPONDENCE IN A
 MANNER THEY SEE FIT, SO THAT THE TENANTS CAN EASILY ACCESS AND VIEW  THE
 NOTICE.
   2. THE NOTICE REQUIRED BY THIS SECTION SHALL BE DEVELOPED BY THE DIVI-
 SION  OF  HOUSING  AND  COMMUNITY RENEWAL AND SHALL INCLUDE, AT MINIMUM,
 INFORMATION ON  MATERIALS  ACCEPTED  FOR  RECYCLING,  INCLUDING  ORGANIC
 WASTE, PROPER PROCEDURES FOR SEPARATING ITEMS, AND RESOURCES FOR TENANTS
 WITH  QUESTIONS  ON WHAT SPECIFIC MATERIALS CAN BE RECYCLED, INCLUDING A
 LINK TO THE DIVISION OF HOUSING AND COMMUNITY RENEWAL'S WEBPAGE ON RECY-
 CLING AND ZERO WASTE. IN ADDITION, THE NOTICE SHALL  PROVIDE  SPACE  FOR
 EACH  BUILDING'S  OWNER,  OR  THE  BUILDING OWNER'S DESIGNATED REPRESEN-
 TATIVE, TO ADVISE TENANTS WHERE TO PLACE MATERIALS TO BE RECYCLED WITHIN
 THEIR BUILDING OR ON THE PREMISES.

 AN  ACT  to  amend  the  administrative code of the city of New York, in
   relation to requiring  certain  landlords  and  property  managers  to
   provide notice to tenants on proper protocols for recycling
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The administrative code of the city of New York is  amended
 by adding a new section 16-315.1 to read as follows:
   §  16-315.1  RECYCLING PROTOCOLS; NOTICE. 1. EACH LANDLORD OR PROPERTY
 MANAGER IN A CITY OF A MILLION OR MORE OF A PUBLIC OR PRIVATE  MULTI-FA-
 MILY  BUILDING SHALL BE REQUIRED TO ISSUE TO EACH TENANT A NOTICE, ANNU-
 ALLY AND UPON SIGNING OF A NEW LEASE AND/OR RENEWAL  LEASE,  TO  EDUCATE
 TENANTS  ABOUT THE TYPES OF ITEMS THAT ARE REQUIRED TO BE SEPARATED FROM
 REGULAR TRASH BY STATE OR LOCAL  LAW,  RULE,  REGULATION  OR  ORDINANCE.
 EACH  LANDLORD  OR  PROPERTY MANAGER SHALL DISTRIBUTE SUCH NOTICE TO ALL
 TENANTS VIA MAIL OR ELECTRONIC CORRESPONDENCE IN A MANNER THEY SEE  FIT,
 SO THAT THE TENANTS CAN EASILY ACCESS AND VIEW THE NOTICE.
