 Introduced by M. of A. LASHER, R. CARROLL, O'PHARROW, SCHIAVONI, SIMONE,
   LEE  --  read once and referred to the Committee on Governmental Oper-
   ations
 
             CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY
 
 proposing an amendment to section 4 of article 3 of the constitution, in
   relation to the redistricting of congressional and  state  legislative
   districts;  and  proposing  an amendment to article 3 of the constitu-
   tion, in relation to redistricting in the event that another state has
   acted to determine the district lines for congressional  offices  more
   than once in less than ten years
 
   Section  1.  Resolved (if the Senate concurs), That subdivision (e) of
 section 4 of article 3  of  the  constitution  be  amended  to  read  as
 follows:
   (e)  The process for redistricting congressional and state legislative
 districts established by this section and sections five  and  five-b  of
 this  article,  AS  WELL  AS THE PROCESS FOR REDISTRICTING CONGRESSIONAL
 DISTRICTS ESTABLISHED BY SECTION FIVE-C OF THIS ARTICLE,  WHEN  APPLICA-
 BLE,  shall govern redistricting in this state except to the extent that
 a court is required to order the adoption of, or changes  to,  a  redis-
 tricting plan as a remedy for a violation of law.
   A  reapportionment plan and the districts contained in such plan shall
 be in force until the effective date of a plan based upon the subsequent
 federal decennial census taken in a year ending in zero unless  modified
 pursuant to court order.
   § 2. Resolved (if the Senate concurs), That article 3 of the constitu-
 tion be amended by adding a new section 5-c to read as follows:
   §  5-C.  IN  THE  EVENT  THAT ANOTHER STATE HAS ACTED TO DETERMINE THE
 DISTRICT LINES FOR CONGRESSIONAL OFFICES MORE THAN ONCE IN LESS THAN TEN
 YEARS, OTHER THAN IN CIRCUMSTANCES WHERE SUCH STATE HAS BEEN ORDERED  TO
 DO  SO  BY A COURT, THE STATE OF NEW YORK, BY AN ACT OF THE LEGISLATURE,
 MAY ALSO ACT TO DETERMINE THE DISTRICT LINES FOR CONGRESSIONAL  OFFICES,
 NOTWITHSTANDING  ANY  LAW  OR  OTHER  PROVISION  OF  THIS ARTICLE TO THE
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
