2025-A9034 (ACTIVE) - Summary

Provides that state-funded SUNY programs shall be reimbursed at no less than 26% of the direct costs; allows state agencies to fund SUNY programs where such state agencies determine that such program would produce administrative efficiencies or cost savings.

 AN  ACT  to amend the state finance law, in relation to funding of state
   university of New York programs by state agencies
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  All  New  York  state sponsored programs conducted by the
 state university of New York and funded by a New York state agency shall
 be reimbursed at no less than twenty-six percent  of  the  direct  costs
 necessary  to fulfill the obligations of such program's terms related to
 costs not otherwise allowable as a direct charge.
   § 2. Section 179-ee of the state finance law is amended  by  adding  a
 new subdivision 4 to read as follows:
   4.  NOTWITHSTANDING ANY OTHER PROVISION OF THIS ARTICLE TO THE CONTRA-
 RY, FOR THE PURPOSES OF A  CONTRACT  FOR  A  NEW  YORK  STATE  SPONSORED
 PROGRAM  CONDUCTED  BY  THE STATE UNIVERSITY OF NEW YORK AND FUNDED BY A
 STATE AGENCY, A STATE AGENCY MAY AWARD A SOLE  SOURCE  CONTRACT  TO  THE
 RESEARCH  FOUNDATION  OF  THE STATE UNIVERSITY OF NEW YORK, ON BEHALF OF
 THE STATE OF NEW YORK, WHEN THE STATE AGENCY DETERMINES  THAT  OPERATION
 OF  SUCH  SPONSORED  PROGRAM  BY  THE STATE UNIVERSITY OF NEW YORK WOULD
 PRODUCE ADMINISTRATIVE EFFICIENCIES OR COST SAVINGS OR  PROGRAM  RESULTS
 WHICH  WOULD  EXCEED  THOSE  LIKELY  TO BE ACHIEVED THROUGH THE USE OF A
 REQUEST FOR PROPOSALS.
   § 3. This act  shall  take  effect  immediately  and  shall  apply  to
 contracts awarded on or after such effective date.
