Relates to nonhuman primates in testing and research facilities; provides that an animal testing facility no longer in need of a nonhuman primate in its possession shall consider options for and determine the appropriate care of such nonhuman primate, including releasing such nonhuman primate to a certified sanctuary; provides that a higher education research facility that receives public money, or a facility that provides research in collaboration with a higher education facility, shall annually publish certain information on its website concerning nonhuman primates at such facility.

ROSENTHAL -- read once and referred to the Committee on Health AN ACT to amend the public health law, in relation to nonhuman primates in testing and research facilities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 504 of the public health law is amended by adding a new subdivision 6 to read as follows: 6. (A) FOR THE PURPOSES OF THIS SUBDIVISION, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS: (1) "CERTIFIED SANCTUARY" MEANS ANY FACILITY THAT PROVIDES TEMPORARY OR PERMANENT SAFE HAVEN TO NONHUMAN PRIMATES THAT IS FULLY ACCREDITED BY THE GLOBAL FEDERATION OF ANIMAL SANCTUARIES. (2) "NONHUMAN PRIMATE" MEANS ALL NONHUMAN MEMBERS OF THE ORDER PRIMATES. (B) ANY ANIMAL TESTING FACILITY THAT NO LONGER HAS NEED FOR A NONHUMAN PRIMATE IN ITS POSSESSION SHALL, IN CONSULTATION WITH SUCH ANIMAL TEST- ING FACILITY'S ATTENDING VETERINARIAN, CONSIDER OPTIONS FOR AND DETER- MINE THE APPROPRIATE CARE AND TREATMENT OF SUCH NONHUMAN PRIMATE, WHICH SHALL INCLUDE OFFERING FOR RELEASE SUCH NONHUMAN PRIMATE TO A CERTIFIED SANCTUARY. SUCH FACILITY SHALL MAKE REASONABLE EFFORTS TO OFFER SUCH NONHUMAN PRIMATES TO A CERTIFIED SANCTUARY. SUCH ANIMAL TESTING FACILI- TY MAY ENTER INTO AN AGREEMENT WITH SUCH CERTIFIED SANCTUARY FOR THE IMPLEMENTATION OF THE PROVISIONS OF THIS PARAGRAPH. NOTHING IN THIS PARAGRAPH SHALL CREATE A DUTY UPON A CERTIFIED SANCTUARY TO ACCEPT A PRIMATE OFFERED BY A LABORATORY OR INSTITUTION. (C) A HIGHER EDUCATION RESEARCH FACILITY THAT RECEIVES PUBLIC MONEY, INCLUDING TAX-EXEMPT STATUS, OR A FACILITY THAT PROVIDES RESEARCH IN COLLABORATION WITH A HIGHER EDUCATION FACILITY SHALL, NO LATER THAN NINETY DAYS AFTER THIS SUBDIVISION SHALL HAVE BECOME A LAW AND ANNUALLY THEREAFTER, CONSPICUOUSLY POST ON ITS WEBSITE THE NUMBER OF NONHUMAN EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
