Decreases the amount of time from eight years to four years for the office of children and family services to inform the provider or licensing agency, or child care resource and referral programs whether or not the person is the subject of an indicated child abuse and maltreatment report.

AN ACT to amend the social services law, in relation to the sealing of
certain records
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Item (II) of clause (B) of subparagraph (i) and clause (B)
of subparagraph (iv) of paragraph (e) of subdivision 1 of section 424-a
of the social services law, as amended by section 9 of part R of chapter
56 of the laws of 2020, are amended to read as follows:
(II) the person is not the subject of an indicated report of child
abuse and is the subject of a report of child maltreatment where the
indication for child maltreatment occurred within less than [eight] FOUR
years from the date of the inquiry.
(B) Where the subject of the report is not the subject of any indi-
cated report of child abuse and is the subject of a report of child
maltreatment where the indication for child maltreatment occurred more
than [eight] FOUR years prior to the date of the inquiry, any such indi-
cation of child maltreatment shall be deemed to be not relevant and
reasonably related to employment.
§ 2. This act shall take effect immediately.
