 AN ACT to amend the vehicle and traffic law, in  relation  to  penalties
   for  failure  of  an  operator  to return shared electric scooters and
   bicycles to a proper location

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The  vehicle  and  traffic law is amended by adding a new
 section 1243-a to read as follows:
   § 1243-A. PENALTIES. ANY SHARED BICYCLE WITH ELECTRIC  ASSIST  SYSTEM,
 AS  DEFINED  IN  THIS  ARTICLE, OPERATING WITHIN THIS STATE SHALL IMPOSE
 MONETARY PENALTIES ON ANY USER OR BORROWER WHO FAILS TO RETURN A  SHARED
 BICYCLE  WITH  ELECTRIC ASSIST TO A PROPER LOCATION AS SPECIFIED, DESIG-
 NATED OR DIRECTED BY THE SYSTEM. SUCH PENALTY  SHALL  BE  IMPOSED  DAILY
 UNTIL THE DEVICE IS RETURNED TO THE PROPER LOCATION.
   §  2.  The  vehicle and traffic law is amended by adding a new section
 1290 to read as follows:
   § 1290. PENALTIES. ANY SHARED ELECTRIC SCOOTER SYSTEM OPERATING WITHIN
 THIS STATE SHALL IMPOSE MONETARY PENALTIES ON ANY USER OR  BORROWER  WHO
 FAILS TO RETURN A SHARED ELECTRIC SCOOTER TO A PROPER LOCATION AS SPECI-
 FIED,  DESIGNATED  OR  DIRECTED  BY  THE  SYSTEM.  SUCH PENALTY SHALL BE
 IMPOSED DAILY UNTIL THE DEVICE IS RETURNED TO THE PROPER  LOCATION.  THE
 TERM SHARED ELECTRIC SCOOTER SYSTEM SHALL MEAN A NETWORK OF SELF-SERVICE
 AND  PUBLICLY  AVAILABLE  ELECTRIC SCOOTERS IN WHICH AN ELECTRIC SCOOTER
 TRIP BEGINS AND/OR ENDS ON ANY PUBLIC HIGHWAY.
   § 3. This act shall take effect on the thirtieth day  after  it  shall
 have become a law.
