 AN ACT to amend the racing, pari-mutuel wagering and  breeding  law,  in
   relation  to requiring annual reports to the governor and the legisla-
   ture by the franchise oversight board
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subparagraph  (xii)  of  paragraph  a of subdivision 8 of
 section 212 of the racing, pari-mutuel wagering  and  breeding  law,  as
 amended  by  chapter  18  of  the  laws  of  2008, is amended to read as
 follows:
   (xii) [report annually] FILE A MANDATORY ANNUAL REPORT to the governor
 and the legislature[, beginning] no later than  December  thirty-first[,
 two  thousand  eight,] OF EACH YEAR stating its findings and recommenda-
 tions to implement policy and legislative changes necessary to encourage
 the continuation of high quality thoroughbred racing in New  York  state
 and  to  protect the legitimate interests of the state and the thorough-
 bred racing industry. SUCH REPORT SHALL INCLUDE, AT A MINIMUM:
   (A) A SUMMARY OF THE FRANCHISE OVERSIGHT BOARD'S ACTIVITIES DURING THE
 PRECEDING YEAR;
   (B) AN ANALYSIS OF THE FRANCHISED CORPORATION'S FINANCIAL  PERFORMANCE
 AND  OPERATION  OF  THOROUGHBRED  RACING AND PARI-MUTUEL WAGERING AT THE
 RACETRACKS;
   (C) WHETHER THE FRANCHISED CORPORATION HAS COMPLIED WITH  THE  DEFINI-
 TIVE DOCUMENTS THAT COMPROMISE THE FRANCHISE AGREEMENT BETWEEN THE FRAN-
 CHISED  CORPORATION  AND  THE  STATE  OF  NEW  YORK,  AND WHETHER IT HAS
 COMPLIED WITH THE LAWS, RULES AND REGULATIONS GOVERNING ITS ACTIVITIES;
   (D) WHETHER THE FRANCHISE OVERSIGHT BOARD HAS NOTIFIED THE  FRANCHISED
 CORPORATION OF ANY MATERIAL BREACH OF PERFORMANCE STANDARDS;
   (E) AN IDENTIFICATION OF POLICY AND REGULATORY CHALLENGES;
   (F) SPECIFIC LEGISLATIVE AND REGULATORY RECOMMENDATIONS; AND
   (G)  ANY OTHER MATTERS THE FRANCHISE OVERSIGHT BOARD DEEMS RELEVANT TO
 ITS OVERSIGHT RESPONSIBILITIES;
   § 2. This act shall take effect immediately.
