 AN ACT to amend the education law, in relation to enacting the  "student
   safety, parent notification, and transparency act"
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Short title. This act shall be known and may  be  cited  as
 the "student safety, parent notification, and transparency act".
   §  2. The education law is amended by adding a new article 2-B to read
 as follows:
                                ARTICLE 2-B
         STUDENT SAFETY, PARENT NOTIFICATION, AND TRANSPARENCY ACT
 SECTION 24. USE OF PHYSICAL RESTRAINT OR FORCE  ON  STUDENTS;  NOTIFICA-
               TION, DOCUMENTATION, REVIEW AND REPORTING REQUIREMENTS.
   §  24.  USE  OF PHYSICAL RESTRAINT OR FORCE ON STUDENTS; NOTIFICATION,
 DOCUMENTATION, REVIEW AND REPORTING REQUIREMENTS. 1. THE PARENT OR GUAR-
 DIAN OF ANY STUDENT SHALL BE NOTIFIED EITHER VERBALLY OR  ELECTRONICALLY
 ON THE SAME DAY ANY PHYSICAL RESTRAINT OR PHYSICAL FORCE IS USED ON SUCH
 STUDENT  IN  A  SCHOOL SETTING. SUCH NOTICE SHALL ALSO INCLUDE A WRITTEN
 INCIDENT REPORT WITHIN TWENTY-FOUR HOURS.
   2. ANY TIME ANY PHYSICAL RESTRAINT OR PHYSICAL  FORCE  IS  USED  ON  A
 STUDENT, THE SCHOOL DISTRICT SHALL DOCUMENT THE DATE, TIME, LOCATION AND
 DURATION  OF  SUCH USE OF RESTRAINT OR FORCE, THE REASON FOR SUCH USE OF
 RESTRAINT OR FORCE, ANY DE-ESCALATION EFFORTS USED, THE  STAFF  INVOLVED
 IN  SUCH  USE  OF  RESTRAINT  OR  FORCE,  AND ANY INJURIES OR OBSERVABLE
 DISTRESS CAUSED BY SUCH USE OF RESTRAINT OR FORCE.
   3. ANY USE OF PHYSICAL RESTRAINT OR PHYSICAL FORCE INVOLVING  STUDENTS
 WITH  DISABILITIES,  INCLUDING  INCIDENTS INVOLVING PRONE OR FLOOR-BASED
 RESTRAINT, INJURY, OR EXTENDED DURATION, CONDUCTED BY PERSONNEL  OUTSIDE
 THE IMMEDIATE SCHOOL BUILDING, SHALL BE INDEPENDENTLY REVIEWED.
   4. PARENTS AND GUARDIANS OF STUDENTS SHALL BE PROVIDED ACCESS TO INCI-
 DENT  RECORDS RELATED TO THE USE OF PHYSICAL RESTRAINT OR PHYSICAL FORCE
 ON SUCH STUDENTS, INCLUDING WRITTEN REPORTS AND ANY PHOTOGRAPHS OR VIDEO
