PHEFFER AMATO, WEPRIN, SAYEGH, CUNNINGHAM, TAYLOR -- read once and referred to the Committee on Banks AN ACT to amend the banking law, in relation to requiring all banking organizations to have a notary public available during business hours THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The banking law is amended by adding a new section 6-q to read as follows: § 6-Q. NOTARY PUBLICS; REQUIRED. EVERY BANKING ORGANIZATION SHALL HAVE A PERSON QUALIFIED AS A NOTARY PUBLIC IN THIS STATE ON STAFF AND AVAIL- ABLE ON THE PREMISES OF EACH FACILITY OF SUCH BANKING ORGANIZATION DURING REGULAR BUSINESS HOURS. SUCH BANKING ORGANIZATION SHALL HAVE THE OPTION TO CHARGE A NOMINAL FEE, NOT TO EXCEED ANY FEE ESTABLISHED IN LAW, FOR ANY NOTARY SERVICES PROVIDED. § 2. This act shall take effect on the ninetieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD02431-01-5
