TITLE OF BILL:

An act establishing the proposition betting task force; and providing
for the repeal of such provisions upon expiration thereof

 
PURPOSE OF BILL:

This bill would establish a task force within Rockefeller Institute to
analyze and report on proposition betting in New York.

 
SUMMARY OF PROVISIONS:

Section I:

-Establishes an independent proposition betting task force to study
proposition bets, with particular consideration of "unders."

-Task force shall be composed of four members:ò

-Two appointed by the Governor -One appointed by the Assembly -One
appointed by the Senate

-The task force will consult with stakeholders with relevant expertise,
experience, or knowledge relating to the following:

-Sports wagering industry;

-Regulation and oversight of sports wagering; -Academic research;

-Economics, statistics, finance, taxation, etc. related to sports wager-
ing;

-Consumer protection and problem gambling; and -Governance and integrity
of professional sporting events.

-The Gaming Commission and mobile sports wagering licensees are required
to provide the task force with information necessary to complete the
study.

-The task force may hold public hearings and solicit public comments
from relevant stakeholders.

-The task force shall analyze the following:

-The types, prevalence, and volume of under bets offered in NYS;

-Integrity risks presented by under bets;

-Economic impacts of under bets on entities authorized to offer under
bets and the state's sports wagering market; -Impact on athletes;

-Consideration of under bets on the governance of sporting events;

-Impacts on consumers;

-The role of sports integrity monitoring systems;
-Potential solutions to risks, integrity concerns, or other issues aris-
ing from under bets and the impacts of such potential solutions;

-The above listed considerations as they relate to prop bets generally

-The task force will provide a report of its findings to be published on
the Gaming Commission website. Section 2 is the effective date.

 
JUSTIFICATION:

The proliferation of proposition bets ("prop bets") tied to the rapid
expansion of legal sports betting has fundamentally altered the sports
landscape, creating a direct link between a bettor's financial outcome
and an individual athlete's performance. Unlike traditional wagers on a
game's final score, prop bets hinge on in-game occurrences, such as a
single player's total rebounds or a specific pitch outcome, making them
uniquely vulnerable to abuse and manipulation.

Recent high-profile scandals underscore these risks. In 2024, the NBA
issued a lifetime ban to Jontay Porter after determining he disclosed
confidential information and altered his own participation to benefit
prop bets on his performance. In late 2025, federal prosecutors charged
professional baseball players in schemes involving manipulation of
micro-betting markets, and at the collegiate level, a January 2026
federal indictment in Philadelphia charged more than 20 individuals,
including a dozen collegiate basketball athletes, with participating in
a conspiracy to bribe and manipulate college basketball games involving
then-active college athletes.

These wagers and the resulting scandals have raised significant concerns
from sports governing bodies, such as the NCAA and NFL, athletes, and
regulators. Following the most recent collegiate basketball scandal, the
NCAA President, Charlie Baker, again formally urged states to eliminate
prop bets to protect athletes and the integrity of sports. He stated
that the NCAA "has opened investigations into potential game manipu-
lation by approximately 40 student-athletes across 20 schools over the
past year." As of early 2026, Louisiana, Maryland, Ohio, and Vermont.
have enacted full bans on college player prop bets.

This bill establishes a task force within the Rockefeller Institute of
Government to study proposition betting in New York State and evaluate
the risks and impacts associated with such wagers, especially so-called
"unders." The task force will analyze the effects of proposition betting
on athletes, sports integrity, consumer protection, and the state's
sports wagering market, and will examine potential regulatory approaches
to address identified risks. The task force will submit its findings and
recommendations to the Governor and the Legislature to inform future
policymaking concerning prop bets in New York.

 AN  ACT  establishing  the proposition betting task force; and providing
   for the repeal of such provisions upon expiration thereof
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. 1. An independent proposition betting task force is hereby
 created and established to examine, evaluate  and  make  recommendations
 concerning  proposition  betting, with particular consideration of under
 bets.
   2. For the purposes of this act, the following terms  shall  have  the
 following meanings:
   (a)  "Proposition  bet" means a sports wager made regarding the occur-
 rence or nonoccurrence of a specific  act,  statistic,  or  other  event
 during a sports event that is not dependent on the final outcome of such
 sports event; and
   (b)  "Under bet" means a sports wager on the individual performance of
 an athlete, including a specific  act,  play  or  event  involving  such
 athlete,  in  which the winning outcome is conditioned upon such athlete
 achieving or being credited with less  than  a  stated  number,  amount,
 threshold,  or  other quantitative measure of performance, including but
 not limited to points, rebounds, assists, yards,  goals,  hits,  strike-
 outs, saves, or minutes played.
   3.  (a)  Such  task force shall consist of four directors appointed as
 follows:
   (i) two members appointed by the governor;
   (ii) one member appointed by the temporary president  of  the  senate;
 and
   (iii) one member appointed by the speaker of the assembly.
   (b) All appointments to the task force shall be made on or before July
 first,  two  thousand  twenty-six.  Any vacancies shall be filled in the
 same manner as the original appointment.

   (c) The members of the task force shall receive  no  compensation  for
 their services, but shall be allowed their actual and necessary expenses
 incurred in the performance of their duties.
   4.  The  task  force shall study and prepare a report on the following
 topics:
   (a) The types, prevalence, wagering  volume,  and  revenue  associated
 with under bets offered in New York;
   (b) Integrity risks presented by under bets;
   (c) The economic impacts of under bets on entities authorized to offer
 sports wagers, and the state's sports wagering market;
   (d)  The  impacts of under bets on athletes, including but not limited
 to, harassment, threats, or other harms  directed  at  athletes  arising
 from under bets;
   (e)  The  impacts  of  under  bets  on the governance and integrity of
 sports events;
   (f) The impacts of under bets on consumers, including  public  percep-
 tion, consumer protection, and problem gambling;
   (g)  The  role of sports integrity monitoring systems, fraud detection
 mechanisms, and law enforcement in identifying  unlawful  or  suspicious
 activity  relating  to under bets, and the extent to which such activity
 is reported to integrity monitoring systems;
   (h) Conflicts of interest or  other  vulnerabilities  associated  with
 under bets;
   (i) Potential solutions to risks, integrity concerns, and other issues
 arising  from  under  bets,  and the potential risks and impacts of such
 solutions;
   (j) The above listed topics as they relate to proposition bets  gener-
 ally; and
   (k)  Existing  laws,  policies and practices related to under bets and
 proposition bets and legislative or administrative  actions  recommended
 to address them.
   5.  (a)  In carrying out its duties pursuant to this section, the task
 force shall consult with  relevant  stakeholders,  organizations,  state
 agencies and relevant subject matter experts representing, to the extent
 practicable,  relevant  expertise,  experience  and knowledge concerning
 proposition bets and sports wagering, including but not limited  to  the
 following:
   (i)  the  sports  wagering industry, including sportsbook operators or
 mobile sports wagering licensees;
   (ii) regulation and oversight of sports wagering, including  represen-
 tatives of the state gaming commission or individuals with experience in
 gaming regulation;
   (iii)  academic or policy research relating to sports wagering, gambl-
 ing behavior, or the economic and social impacts of gambling;
   (iv) economics, statistics, finance, tax revenue,  or  related  disci-
 plines relevant to sports wagering markets;
   (v)  consumer  protection, problem gambling prevention, or responsible
 gaming advocacy; and
   (vi) professional sports leagues, collegiate athletic associations, or
 other organizations responsible for  the  governance  and  integrity  of
 sports events.
   (b)  The  state gaming commission and mobile sports wagering licensees
 shall cooperate with the task force and provide aggregated  and  anonym-
 ized data to the extent permitted by law.

   (c)  The  task force may hold public hearings, solicit public comment,
 and request information from relevant stakeholders as it deems necessary
 to carry out its duties.
   6.  (a)  On  or before December thirty-first, two thousand twenty-six,
 the task force shall submit a report of its findings and recommendations
 to the governor, the temporary president of the senate, and the  speaker
 of the assembly.
   (b)  Such report shall include findings on the topics listed in subdi-
 vision four of this section.
   (c) Upon submission, such report shall be made publicly available  and
 posted on the website of the New York state gaming commission.
   §  2.  This  act shall take effect immediately and shall expire and be
 deemed repealed ninety days after the submission of the report  required
 pursuant  to section one of this act; provided that the chair of the New
 York state gaming commission shall notify the legislative bill  drafting
 commission upon the submission of the report provided for in subdivision
 6  of  section one of this act in order that the commission may maintain
 an accurate and timely effective data base of the official text  of  the
 laws  of  the  state  of  New  York  in  furtherance of effectuating the
 provisions of section 44 of the legislative law and section 70-b of  the
 public officers law.
