2025-S10219 (ACTIVE) - Summary

Requires an insurance company which owns a health care provider to pay any health care provider which it does not own an amount that is no less than the amount that it pays a health care provider which it does own for a comparable service; prohibits an insurance company which is owned by a health care provider from paying any health care provider which does not own such insurance company an amount that is less than the amount that it pays a health care provider which does own such company for a comparable service.

 AN  ACT  to  amend the insurance law, in relation to health care payment
   amounts
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1. Section 3224-a of the insurance law is amended by adding a
 new subsection (m) to read as follows:
   (M)(1) ANY INSURANCE COMPANY WHICH OWNS A HEALTH  CARE  PROVIDER  MUST
 PAY  ANY HEALTH CARE PROVIDER WHICH IT DOES NOT OWN AN AMOUNT THAT IS NO
 LESS THAN THE AMOUNT THAT IT PAYS A HEALTH CARE PROVIDER WHICH  IT  DOES
 OWN FOR A COMPARABLE SERVICE.
   (2)  ANY  INSURANCE COMPANY, WHICH IS OWNED BY A HEALTH CARE PROVIDER,
 MAY NOT PAY ANY HEALTH CARE PROVIDER WHICH DOES NOT OWN  SUCH  INSURANCE
 COMPANY  AN  AMOUNT  THAT  IS LESS THAN THE AMOUNT THAT IT PAYS A HEALTH
 CARE PROVIDER WHICH DOES OWN SUCH COMPANY FOR A COMPARABLE SERVICE.
   § 2. This act shall take effect on the sixtieth  day  after  it  shall
 have become a law.
