TITLE OF BILL:

An act to amend the public service law, in relation to establishing a
long-duration energy storage procurement target in New York state

 
PURPOSE OR GENERAL IDEA OF BILL:  To direct the New York State Energy
Research and Development Authority (NYSERDA) and the Public Service
Commission (PSC) to establish and implement a statewide procurement
target for long-duration energy storage (LDES) to support grid reliabil-
ity, facilitate integration of renewable energy resources, and reduce
system-wide costs while advancing the State's clean energy goals.

 
SUMMARY OF PROVISIONS:

Section 1 amends Article 4 of the public service law by adding a new
section 66-I to:

* Set forth legislative findings regarding the role of long-duration
energy storage in achieving least-cost clean energy, maintaining grid

reliability, improving resilience, and supporting economic development.

* Define "long-duration energy storage" (LDES) as any energy storage
system capable of storing and discharging electricity for ten or more
hours at nameplate capacity and further define "inter-day LDES" (10-24
hours) and "multi-day LDES" (24 or more hours).

* Establish a statewide procurement target requiring NYSERDA to contract
for at least 3,000 megawatts (MW) of incremental LDES capacity by Decem-
ber 31, 2030, including at least 1,500 MW of inter-day LDES and at least
1,500 MW of multi-day LDES.

* Require the PSC, in consultation with NYSERDA, to publish an LDES
roadmap by July 1, 2027, describing the plan and timeline to achieve the
procurement target, including competitive solicitations, incentive
programs, or other procurement mechanisms, and coordination with rele-
vant agencies to facilitate timely permitting and interconnection.

* Require the PSC to adopt one or more procurement programs to achieve
the procurement target and ensure such programs commence no later than
July 1, 2028.

* Provide that the procurement target does not limit additional LDES
deployment beyond the required 3,000 MW.

Section 2 states the effective date.

 
JUSTIFICATION:

Current law does not establish a statewide procurement target specific
to long-duration energy storage (ten or more hours) or require a dedi-
cated PSC roadmap and procurement program timeline tailored to inter-day
and multi-day LDES deployment.

New York's transition to a zero-emission electric grid will require
resources that can balance variable renewable generation over extended
periods, particularly during multi-hour and multi-day weather events
when solar and wind output may be limited.  Long-duration energy storage
technologies can provide sustained capacity and essential reliability
services, reduce reliance on peaking resources, and help manage system-
wide costs for ratepayers.  Establishing a clear statewide procurement
target and implementation roadmap will provide market certainty, encour-
age private investment, and enable the State to deploy a diverse portfo-
lio of storage technologies needed to meet reliability and affordability
objectives as New York advances toward its clean energy goals.

FISCAL IMPLICATIONS:

To be determined. Any fiscal impact will depend on program design,
procurement volumes and timing, and resulting effects on system costs.
Program costs and benefits are expected to be considered by the PSC in
establishing procurement mechanisms intended to achieve the target at
least cost.

 
EFFECTIVE DATE:
This act shall take effect immediately.

 AN  ACT  to  amend the public service law, in relation to establishing a
   long-duration energy storage procurement target in New York state
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The public service law is amended by adding a new section
 66-i to read as follows:
   § 66-I. LONG-DURATION ENERGY STORAGE PROCUREMENT TARGET. 1.   LEGISLA-
 TIVE FINDINGS AND DECLARATION. THE LEGISLATURE FINDS AND DECLARES THAT:
   (A)  LONG-DURATION  ENERGY  STORAGE  ("LDES")  IS CRITICAL TO ENABLING
 AFFORDABILITY FOR RATEPAYERS,  MAINTAINING  GRID  RELIABILITY,  REDUCING
 SYSTEM-WIDE COSTS, STRENGTHENING ENERGY INDEPENDENCE AND ECONOMIC DEVEL-
 OPMENT, SUPPORTING RESILIENCE TO EXTREME WEATHER EVENTS, AND INTEGRATING
 RENEWABLE RESOURCES.
   (B)  ACHIEVING THE STATE'S CLEAN ENERGY GOALS AT LEAST COST, INCLUDING
 ONE HUNDRED PERCENT ZERO-EMISSION ELECTRICITY  BY  TWO  THOUSAND  FORTY,
 REQUIRES  DEPLOYMENT  OF  A  PORTFOLIO OF ENERGY STORAGE TECHNOLOGIES OF
 DIFFERENT DURATIONS.
   (C) A STATEWIDE PROCUREMENT TARGET FOR LDES  WILL  PROVIDE  REGULATORY
 CERTAINTY, ENCOURAGE INVESTMENT, AND SUPPORT THE ECONOMIC DEVELOPMENT OF
 TECHNOLOGIES THAT ENABLE RELIABLE, LOW-COST POWER.
   2.  DEFINITIONS.  AS  USED  IN THIS SECTION, THE FOLLOWING TERMS SHALL
 HAVE THE FOLLOWING MEANINGS:
   (A) "LONG-DURATION ENERGY STORAGE" OR "LDES"  SHALL  MEAN  ANY  ENERGY
 STORAGE SYSTEM CAPABLE OF STORING AND DISCHARGING ELECTRICITY FOR TEN OR
 MORE  HOURS  AT  NAMEPLATE  CAPACITY,  INCLUDING BOTH INTER-DAY LDES AND
 MULTI-DAY LDES.
   (B) "INTER-DAY LDES" SHALL MEAN ANY ENERGY STORAGE SYSTEM  CAPABLE  OF
 STORING AND DISCHARGING ELECTRICITY FOR A DURATION BETWEEN TEN AND TWEN-
 TY-FOUR HOURS AT NAMEPLATE CAPACITY.

   (C)  "MULTI-DAY  LDES" SHALL MEAN ANY ENERGY STORAGE SYSTEM CAPABLE OF
 STORING AND DISCHARGING ELECTRICITY FOR TWENTY-FOUR  OR  MORE  HOURS  AT
 NAMEPLATE CAPACITY.
   (D) "PROCUREMENT TARGET" SHALL MEAN THE AMOUNT OF INCREMENTAL LONG-DU-
 RATION  ENERGY  STORAGE CAPACITY CONTRACTED BY THE AUTHORITY PURSUANT TO
 THIS SECTION.
   (E) "AUTHORITY" SHALL MEAN THE NEW  YORK  STATE  ENERGY  RESEARCH  AND
 DEVELOPMENT AUTHORITY.
   3.  LONG-DURATION  ENERGY  STORAGE PROCUREMENT TARGET. (A) BY DECEMBER
 THIRTY-FIRST, TWO THOUSAND THIRTY, THE AUTHORITY SHALL CONTRACT AT LEAST
 THREE THOUSAND MEGAWATTS OF  INCREMENTAL  LONG-DURATION  ENERGY  STORAGE
 CAPACITY,  INCLUDING  AT  LEAST  ONE  THOUSAND FIVE HUNDRED MEGAWATTS OF
 INTER-DAY LDES AND AT LEAST  ONE  THOUSAND  FIVE  HUNDRED  MEGAWATTS  OF
 MULTI-DAY LDES.
   (B)  NO  LATER THAN JULY FIRST, TWO THOUSAND TWENTY-SEVEN, THE COMMIS-
 SION, IN CONSULTATION WITH THE AUTHORITY, SHALL PUBLISH AN LDES  ROADMAP
 THAT  ESTABLISHES  A PLAN AND TIMELINE TO ACHIEVE THE PROCUREMENT TARGET
 ESTABLISHED PURSUANT TO THIS SECTION. SUCH ROADMAP SHALL  DESCRIBE,  BUT
 SHALL  NOT BE LIMITED TO, COMPETITIVE SOLICITATIONS, INCENTIVE PROGRAMS,
 OR OTHER PROCUREMENT MECHANISMS TO ACHIEVE THE PROCUREMENT  TARGET,  AND
 COORDINATE STRATEGIES WITH RELEVANT AGENCIES TO ENSURE TIMELY PERMITTING
 AND INTERCONNECTION TO ACHIEVE THE PROCUREMENT TARGET.
   (C)  THE  COMMISSION  SHALL  ADOPT ONE OR MORE PROCUREMENT PROGRAMS TO
 ACHIEVE THE PROCUREMENT TARGET  AND  ENSURE  SUCH  PROGRAM  OR  PROGRAMS
 COMMENCE NO LATER THAN JULY FIRST, TWO THOUSAND TWENTY-EIGHT.
   (D) THE PROCUREMENT TARGET SHALL NOT LIMIT ANY ADDITIONAL LDES DEPLOY-
 MENT BEYOND THE REQUIRED THREE THOUSAND MEGAWATTS.
   § 2. This act shall take effect immediately.
