 AN  ACT to amend the agriculture and markets law, in relation to requir-
   ing the completion of animal cruelty prevention workshops  by  certain
   persons
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The agriculture and markets law is amended by adding a  new
 section 387 to read as follows:
   §  387.  ANIMAL  CRUELTY  PREVENTION  WORKSHOPS  REQUIRED.  1. FOR THE
 PURPOSES OF THIS SECTION, THE TERM "FARM OPERATION" SHALL HAVE THE  SAME
 MEANING  AS  SUCH  TERM  IS DEFINED BY SECTION THREE HUNDRED ONE OF THIS
 CHAPTER.
   2. ANY PERSON WHO PURCHASES, ACQUIRES OR INITIATES A FARM OPERATION ON
 WHICH HORSES AND/OR COWS ARE KEPT SHALL  COMPLETE  A  SERIES  OF  ANIMAL
 CRUELTY  PREVENTION  WORKSHOPS IN A FORM AND MANNER AS PRESCRIBED BY THE
 DEPARTMENT IN REGULATION. SUCH  WORKSHOPS  SHALL  INCLUDE,  BUT  NOT  BE
 LIMITED TO, INSTRUCTION ON THE FOLLOWING:
   (A) THE APPLICABLE PROVISIONS OF THIS ARTICLE GOVERNING ANIMAL CRUELTY
 AND RELATED ANIMAL CRUELTY LAWS IN THE STATE;
   (B) ANIMAL HUSBANDRY, INCLUDING SIGNS OF ABUSE AND NEGLECT; AND
   (C)  THE  ROLE  OF  LAW  ENFORCEMENT, VETERINARIANS, AND THE PUBLIC IN
 PREVENTING ANIMAL CRUELTY AND REPORTING SUCH CRUELTY TO PROPER  AUTHORI-
 TIES.
   3. THE DEPARTMENT SHALL (A) ISSUE A CERTIFICATION OF COMPLETION TO ANY
 PERSON  WHO  HAS  SUCCESSFULLY  COMPLETED  THE ANIMAL CRUELTY PREVENTION
 WORKSHOPS PURSUANT TO SUBDIVISION TWO OF THIS SECTION AND (B)  ESTABLISH
 AND CHARGE FEES IN CONNECTION WITH SUCH WORKSHOPS.
   §  2.  This  act shall take effect on the ninetieth day after it shall
 have become a law. Effective immediately, the addition, amendment and/or
 repeal of any rule or regulation necessary  for  the  implementation  of
 this  act  on its effective date are authorized to be made and completed
 on or before such effective date.
