 Introduced  by  Sen.  RHOADS -- read twice and ordered printed, and when
   printed to be committed to the Committee on Labor
 
 AN ACT to amend the labor law,  in  relation  to  creating  a  temporary
   committee on examining the New York state industrial code; and provid-
   ing for the repeal of such provisions upon expiration thereof

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The labor law is amended by adding a new section 45 to read
 as follows:
   § 45. JOINT COMMITTEE FOR INDUSTRIAL CODE OVERSIGHT. 1. THERE IS HERE-
 BY ESTABLISHED A JOINT COMMITTEE  ON  EVALUATING  THE  STATE  INDUSTRIAL
 CODE.   SUCH COMMITTEE SHALL CONSIST OF ELEVEN MEMBERS ONE OF WHOM SHALL
 BE A REPRESENTATIVE OF THE NEW  YORK  STATE  BUILDING  AND  CONSTRUCTION
 TRADES;  A  REPRESENTATIVE  FROM THE NEW YORK STATE AFL-CIO; A REPRESEN-
 TATIVE FROM THE NEW YORK CITY CENTRAL LABOR  COUNCIL;  A  REPRESENTATIVE
 FROM THE LABORERS INTERNATIONAL UNION OF NORTH AMERICA; A REPRESENTATIVE
 FROM THE NEW YORK COMMITTEE FOR OCCUPATIONAL SAFETY AND HEALTH; A MEMBER
 APPOINTED BY THE GOVERNOR; A MEMBER APPOINTED BY THE TEMPORARY PRESIDENT
 OF  THE  SENATE;  A  MEMBER  APPOINTED  BY THE SENATE MINORITY LEADER; A
 MEMBER APPOINTED BY THE SPEAKER OF THE ASSEMBLY; A MEMBER  APPOINTED  BY
 THE  ASSEMBLY  MINORITY  LEADER; AND A NON-VOTING CHAIR APPOINTED BY THE
 COMMISSIONER. MEMBERS OF THE COMMITTEE SHALL SERVE AT  THE  PLEASURE  OF
 THE  APPOINTING  AUTHORITY.    MEMBERS OF THE COMMITTEE SHALL RECEIVE NO
 COMPENSATION FOR THEIR SERVICES BUT SHALL BE ALLOWED  THEIR  ACTUAL  AND
 NECESSARY  EXPENSES INCURRED IN THE PERFORMANCE OF THEIR DUTIES PURSUANT
 TO THIS SECTION.
   2. THE COMMITTEE ESTABLISHED PURSUANT TO THIS SECTION SHALL CONDUCT  A
 REVIEW  OF PART TWENTY-THREE OF THE NEW YORK STATE INDUSTRIAL CODE AS IT
 PERTAINS TO CONSTRUCTION, DEMOLITION AND  EXCAVATION  ACTIVITIES  WITHIN
 THE  STATE  OF  NEW YORK; REVIEW OCCUPATIONAL SAFETY AND HEALTH ADMINIS-
 TRATION, AMERICAN NATIONAL STANDARDS INSTITUTE AND OTHER  NATIONALLY-RE-
 COGNIZED  CONSTRUCTION  AND SAFETY STANDARDS TO DETERMINE IF ANY CHANGES
 RECOMMENDED TO SUCH CODE SHOULD OCCUR.
