TITLE OF BILL:

An act to amend the general business law, in relation to fairness in
youth sports

 
PURPOSE:

This bill establishes consumer protections for families participating in
competitive youth sports organizations, addressing predatory contract
terms, hidden fees, data exploitation, and accountability gaps enabled
by private investment in the youth sports industry.

 
SUMMARY OF PROVISIONS:

Before a sports season begins, youth sports organizations must provide
participants with a complete itemized list of all mandatory costs. No
fees beyond what was disclosed can be charged, and any contract term
purporting to authorize undisclosed fees is void.

Contracts for participation may not require exclusivity, impose stay-to-
play arrangements, lock participants into commitments longer than one
season, or impose financial penalties for withdrawal before the season
ends. Forfeiture of costs already paid is permitted; penalties for leav-
ing are not. Every contract must include a plain-language summary of its
material terms.

Stay-to-play arrangements, which condition participation on using a
designated travel or lodging vendor, are prohibited. Organizations
cannot threaten disqualification, manipulate seeding, or impose any
other penalty to enforce such arrangements.

Youth sports organizations may not sell or transfer participant data for
commercial purposes, use it for targeted advertising, or retain it after
a participant requests deletion.

Any person or entity holding ten percent or more ownership in a youth
sports organization, or exercising unilateral decision-making authority
over it, is jointly and severally liable for violations of this bill and
for violations of state labor and minor safety laws, regardless of
corporate structure.

The Attorney General may assess civil penalties for violations.  Partic-
ipants may also sue in their own names or on behalf of their minor chil-
dren to enjoin violations or recover actual damages, with attorney's
fees available to prevailing plaintiffs. Class actions are expressly
permitted.

The bill does not apply to public school programs, the New York State
Public High School Athletic Association, or any organization whose total
annual costs per participant are $750 or less.

 
JUSTIFICATION:

Youth sports are one of the most formative experiences available to
young people. They build discipline, resilience, friendship, and a
relationship with physical activity that can last a lifetime. New York
families invest heavily in those experiences, and they deserve to do so
on fair terms.

That is not always what they get. Across the country, and in New York,
the competitive youth sports industry has grown into a significant
commercial market. Private equity investment has consolidated control of
many organizations, and the incentives that follow have not always
aligned with the interests of children and families. Contracts obscure
true costs. Stay-to-play arrangements use children's playing time as
leverage to extract money from families on travel and lodging. Player
platforms collect detailed personal and biometric data on minors and
face no meaningful restrictions on what happens to it.

Children are not products. Their performance data should not be sold.
Their families should not be trapped by contracts designed to extract
rather than serve. Their access to competition should not depend on
which hotel their parents book.

This bill restores basic fairness to the relationship between youth
sports organizations and the families they exist to serve. It requires
honest disclosure of costs, prohibits the most exploitative contract
terms, bans coercive travel arrangements, and protects the personal data
of minor participants. It holds controlling investors accountable for
the conduct of the organizations they profit from.  Youth sports should
be about kids. This bill helps keep them that way.

 AN ACT to amend the general business law, in  relation  to  fairness  in
   youth sports
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The general business law is amended by adding a new article
 41-A to read as follows:
                               ARTICLE 41-A
                               YOUTH SPORTS
 SECTION 1050. DEFINITIONS.
         1051. DISCLOSURE OF TOTAL ANNUAL COSTS.
         1052. YOUTH SPORTS CONTRACTS.
         1053. STAY-TO-PLAY PROHIBITED.
         1054. DATA PRIVACY.
         1055. INVESTOR LIABILITY.
         1056. ENFORCEMENT.
         1057. EXEMPTIONS.
   § 1050. DEFINITIONS. FOR THE PURPOSES OF THIS ARTICLE,  THE  FOLLOWING
 TERMS SHALL HAVE THE FOLLOWING MEANINGS:
   1.  "YOUTH  SPORTS  ORGANIZATION"  MEANS  ANY  ENTITY  THAT ORGANIZES,
 MANAGES, GOVERNS, HOSTS OR RUNS YOUTH SPORTS  EVENTS,  AND  WHERE  TOTAL
 ANNUAL  COSTS FOR PARTICIPATION IN SUCH YOUTH SPORTS ORGANIZATION EXCEED
 SEVEN HUNDRED FIFTY DOLLARS FOR A SINGLE SPORTS SEASON.
   2. "YOUTH SPORTS EVENT" MEANS ANY ORGANIZED ATHLETIC  EVENT,  GAME  OR
 COMPETITION  IN  WHICH THE MAJORITY OF PARTICIPANTS ARE UNDER THE AGE OF
 EIGHTEEN.
   3. "TOTAL ANNUAL COSTS" MEANS THE TOTAL MANDATORY  COSTS  FOR  PARTIC-
 IPATION  IN A YOUTH SPORTS ORGANIZATION OVER THE COURSE OF AN INDIVIDUAL
 SPORTS SEASON, REGARDLESS OF WHEN  PAYMENTS  FOR  SUCH  COSTS  ARE  DUE,
 INCLUDING  BUT  NOT  LIMITED TO, REGISTRATION FEES, EQUIPMENT COSTS, AND
 TRAVEL COSTS.
   4. "PLAYER PLATFORM" MEANS ANY DIGITAL SYSTEM USED BY A  YOUTH  SPORTS
 ORGANIZATION FOR REGISTRATION, TRACKING, RECRUITING, OR DATA COLLECTION.

   5.  "CONTROLLING  INVESTOR"  MEANS A PERSON OR OTHER ENTITY HAVING TEN
 PERCENT OWNERSHIP OR MORE OF, OR  UNILATERAL  DECISION-MAKING  AUTHORITY
 OVER, A YOUTH SPORTS ORGANIZATION.
   6.  "STAY-TO-PLAY  ARRANGEMENT"  MEANS CONDITIONING PARTICIPATION IN A
 YOUTH SPORTS ORGANIZATION ON USING A DESIGNATED  VENDOR,  INCLUDING  BUT
 NOT LIMITED TO, TRAVEL OR LODGING VENDORS.
   7.  "SPORTS  SEASON" MEANS THE SPECIFIC PERIOD WITHIN A ONE-YEAR TIME-
 FRAME WITHIN WHICH  A  YOUTH  SPORTS  ORGANIZATION  HOLDS  YOUTH  SPORTS
 EVENTS,  INCLUDING  ANY  PRESEASON,  REGULAR SEASON AND POSTSEASON YOUTH
 SPORTS EVENTS AND PRACTICES.
   8. "PARTICIPANT" MEANS ANY PERSON  PARTICIPATING  IN  A  YOUTH  SPORTS
 ORGANIZATION AND THEIR PARENTS AND/OR GUARDIANS.
   9.  "PERSONAL DATA" MEANS ANY DATA THAT IDENTIFIES OR COULD REASONABLY
 BE LINKED, DIRECTLY OR INDIRECTLY, WITH A  SPECIFIC  NATURAL  PERSON  OR
 HOUSEHOLD,  INCLUDING  BUT  NOT  LIMITED  TO, INFORMATION COLLECTED BY A
 YOUTH  SPORTS  ORGANIZATION  WITH  REGISTRATION  DOCUMENTS,  BIOMETRICS,
 PERFORMANCE TRACKING, FINANCIAL INFORMATION, OR LOCATION.
   §  1051. DISCLOSURE OF TOTAL ANNUAL COSTS. 1. EACH YOUTH SPORTS ORGAN-
 IZATION SHALL PROVIDE ANY PARTICIPANT WITH A FULL ITEMIZED LIST IN WRIT-
 ING OF SUCH TOTAL ANNUAL COSTS BEFORE THE START OF SUCH  SPORTS  SEASON.
 NO  FEES OR OTHER ADDITIONAL CHARGES SHALL BE IMPOSED ON ANY PARTICIPANT
 THAT WAS NOT INCLUDED IN SUCH ITEMIZED LIST.
   2. ANY PROVISION OF A CONTRACT FOR PARTICIPATION  IN  A  YOUTH  SPORTS
 ORGANIZATION  AUTHORIZING UNDISCLOSED FEES OR OTHER CHARGES IN VIOLATION
 OF SUBDIVISION ONE OF THIS SECTION SHALL BE VOID.
   3. WHERE A VIOLATION OF THIS SECTION IS ALLEGED TO HAVE OCCURRED,  THE
 ATTORNEY GENERAL SHALL BE AUTHORIZED TO ASSESS A PENALTY OF FIVE HUNDRED
 DOLLARS PER VIOLATION PER PARTICIPANT.
   §  1052.  YOUTH  SPORTS CONTRACTS. 1. NO CONTRACT FOR PARTICIPATION IN
 YOUTH SPORTS ORGANIZATION SHALL CONTAIN ANY PROVISION:
   (A) REQUIRING EXCLUSIVITY WITH SUCH  YOUTH  SPORTS  ORGANIZATION  THAT
 PROHIBITS PARTICIPATION IN ANY OTHER YOUTH SPORTS ORGANIZATION;
   (B) INCLUDING A STAY-TO-PAY ARRANGEMENT;
   (C)  REQUIRING  COMMITMENT  TO SUCH YOUTH SPORTS ORGANIZATION FOR MORE
 THAN ONE SPORTS SEASON; OR
   (D) IMPOSING FINANCIAL PENALTIES FOR A PARTICIPANT'S WITHDRAWAL BEFORE
 THE END OF A SPORTS SEASON, PROVIDED, HOWEVER, THAT ANY  SUCH  PROVISION
 PROVIDING  FOR  THE FORFEITURE OF COSTS ALREADY PAID PRIOR TO SUCH WITH-
 DRAWAL SHALL NOT BE IN VIOLATION OF THIS PARAGRAPH.
   2. EVERY CONTRACT FOR PARTICIPATION IN  A  YOUTH  SPORTS  ORGANIZATION
 SHALL  CONTAIN A PLAIN-LANGUAGE SUMMARY OF ALL MATERIAL TERMS, INCLUDING
 BUT NOT LIMITED TO, AN ITEMIZED LIST OF TOTAL ANNUAL COSTS IN ACCORDANCE
 WITH SUBDIVISION ONE OF SECTION ONE THOUSAND FIFTY-ONE OF THIS ARTICLE.
   § 1053. STAY-TO-PLAY PROHIBITED. NO YOUTH  SPORTS  ORGANIZATION  SHALL
 IMPOSE  PENALTIES OF ANY KIND AS PART OF A STAY-TO-PLAY ARRANGEMENT WITH
 ANY VENDOR, INCLUDING, BUT NOT LIMITED TO, THREATENED  DISQUALIFICATION,
 PREFERENTIAL SEEDING, OR ANY OTHER PENALTIES.
   §  1054.  DATA  PRIVACY. 1. NO YOUTH SPORTS ORGANIZATION SHALL SELL OR
 TRANSFER ANY PERSONAL DATA  RELATED  TO  A  PARTICIPANT  FOR  COMMERCIAL
 PURPOSES.
   2. NO YOUTH SPORTS ORGANIZATION SHALL USE PERSONAL DATA RELATED TO ANY
 PARTICIPANT FOR THE PURPOSES OF TARGETED ADVERTISING.
   3.  ANY  PARTICIPANT  SHALL HAVE THE RIGHT TO HAVE THEIR PERSONAL DATA
 DELETED BY A YOUTH SPORTS ORGANIZATION UPON REQUEST.

   4. WHERE A VIOLATION OF THIS SECTION IS ALLEGED TO HAVE OCCURRED,  THE
 ATTORNEY GENERAL SHALL BE AUTHORIZED TO ASSESS A PENALTY OF ONE THOUSAND
 DOLLARS PER VIOLATION PER PARTICIPANT.
   §  1055.  INVESTOR  LIABILITY. CONTROLLING INVESTORS OF A YOUTH SPORTS
 ORGANIZATION SHALL BE JOINTLY AND SEVERALLY LIABLE FOR ANY VIOLATIONS OF
 THIS ARTICLE, OR OF ANY OTHER LAWS OF THE STATE REGULATING LABOR OR  THE
 SAFETY  OF  MINORS, BY SUCH YOUTH SPORTS ORGANIZATION, REGARDLESS OF THE
 CORPORATE FORM OF SUCH YOUTH SPORTS ORGANIZATION.
   § 1056. ENFORCEMENT. 1. WHERE A VIOLATION OF THIS ARTICLE  IS  ALLEGED
 TO  HAVE  OCCURRED, THE ATTORNEY GENERAL SHALL BE AUTHORIZED TO ASSESS A
 CIVIL PENALTY AS DETERMINED BY THE ATTORNEY GENERAL, UNLESS  A  SPECIFIC
 AMOUNT THEREFOR IS OTHERWISE PROVIDED FOR UNDER THIS ARTICLE.
   2.  ANY  PERSON  WHO HAS BEEN INJURED BY REASON OF A VIOLATION OF THIS
 SECTION MAY BRING AN ACTION IN THEIR OWN NAME, OR IN THE NAME  OF  THEIR
 MINOR  CHILD,  TO  ENJOIN  SUCH UNLAWFUL ACT, OR TO RECOVER THEIR ACTUAL
 DAMAGES. THE COURT SHALL AWARD REASONABLE ATTORNEY'S FEES TO A  PREVAIL-
 ING  PLAINTIFF.  ACTIONS  PURSUANT TO THIS PARAGRAPH MAY BE BROUGHT ON A
 CLASS-WIDE BASIS.
   § 1057. EXEMPTIONS. THE PROVISIONS OF THIS ARTICLE SHALL NOT APPLY  TO
 YOUTH SPORTS ORGANIZATIONS:
   1. MANAGED BY A PUBLIC SCHOOL OR GROUP OF PUBLIC SCHOOLS IN THE STATE;
   2.  MANAGED  BY THE NEW YORK STATE PUBLIC HIGH SCHOOL ATHLETIC ASSOCI-
 ATION; OR
   3. FOR WHICH TOTAL ANNUAL COSTS FOR EACH PARTICIPANT AMOUNT  TO  SEVEN
 HUNDRED FIFTY DOLLARS OR LESS.
   § 2. This act shall take effect immediately.
