TITLE OF BILL:

An act to amend the administrative code of the city of New York, in
relation to longevity bonuses for members of the uniformed service with
the New York city fire department

 
SUMMARY OF PROVISIONS:

Section 1 amends Section 15-110.1 of the administrative code of the City
of New York to:

1. Increase the annual salary at a rate of five percent for such final
average salary period, imputed for final average salary purposes with
the New York city fire department pension fund, of members that have
accrued twenty-five years of service credit with the New York City fire
department pension fund.

2. Increase the annual salary at a rate of ten percent for such final
average salary period, imputed for final average salary purposes with
the New York city fire department pension fund, of members that have

accrued thirty years of service credit with the New York City fire
department pension fund.

3. Increase the annual salary at a rate of fifteen percent for such
final average salary period, imputed for final average salary purposes
with the New York City fire department pension fund, of members that
have accrued thirty-five years of service credit with the New York City
fire department pension fund.

4. Commencing with the twenty-sixth year of service and for each year
thereafter, increase the annual salary of such member by an additional
one per cent annually, added to the applicable salary used for the
purposes of computing pension benefits under the New York City fire
pension fund, provided, however, that the total additional credit pursu-
ant to this subdivision shall not exceed fifteen per cent and shall be
capped upon the completion of thirty-five years of uniformed service
with the department.

Section 2 establishes the effective date.

 
JUSTIFICATION:

This legislation serves to strengthen recruitment and retention efforts
by offering incentives that encourage experienced uniformed firefighters
and other uniformed ranks of the fire department to continue their
public service. Keeping seasoned members in these ranks on the job
directly enhances public safety, as their knowledge and expertise would
provide critical guidance and mentorship to younger members of the
department. Pension-related benefit costs for new hires typically exceed
the pension costs associated with present-day retirees. This legislation
would mitigate the impact of pension liabilities, while maximizing the
City's prior investment in training and development of members to serve
in these ranks, through this enhanced recruitment and retention. More-
over, while reducing pension expenses that put a strain on the City's
budget, this legislation would also assist in maintaining adequate
staffing levels.

 AN ACT to amend the administrative code of the  city  of  New  York,  in
   relation  to  longevity  bonuses  for members of the uniformed service
   with the New York city fire department
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. The administrative code of the city of New York is amended
 by adding a new section 15-110.1 to read as follows:
   § 15-110.1 LONGEVITY BONUSES. A. (1) NOTWITHSTANDING ANY PROVISION  OF
 LAW  TO THE CONTRARY, WHEN A MEMBER SHALL HAVE ACCRUED TWENTY-FIVE YEARS
 OF UNIFORMED SERVICE WITH THE NEW YORK CITY FIRE DEPARTMENT, AND RETIRES
 IN ANY RANK, THEY SHALL HAVE FIVE PER CENTUM OF THE HIGHEST GRADE OF PAY
 UNDER THE APPLICABLE COLLECTIVE BARGAINING AGREEMENT  OF  SUCH  RANK  IN
 WHICH THEY RETIRE, ADDED TO THE APPLICABLE SALARY, USED FOR THE PURPOSES
 OF  COMPUTING PENSION BENEFITS UNDER THE PLAN IN WHICH THEY ARE ENROLLED
 WITH THE NEW YORK CITY FIRE DEPARTMENT PENSION FUND; OR
   (2) NOTWITHSTANDING ANY PROVISION OF  LAW  TO  THE  CONTRARY,  WHEN  A
 MEMBER SHALL HAVE ACCRUED THIRTY YEARS OF UNIFORMED SERVICE WITH THE NEW
 YORK  CITY FIRE DEPARTMENT, AND RETIRES IN ANY RANK, THEY SHALL HAVE TEN
 PER CENTUM OF THE HIGHEST GRADE OF PAY UNDER THE  APPLICABLE  COLLECTIVE
 BARGAINING  AGREEMENT  OF  SUCH  RANK IN WHICH THEY RETIRE, ADDED TO THE

 COLLECTIVE BARGAINING AGREEMENT OF SUCH RANK IN WHICH THEY RETIRE, ADDED

   B.  IN  ADDITION  TO  THE INCREASES SET FORTH IN SUBDIVISION A OF THIS
 SECTION, COMMENCING WITH THE TWENTY-SIXTH YEAR OF SERVICE AND  FOR  EACH
 YEAR  THEREAFTER, SUCH MEMBER SHALL RECEIVE AN ADDITIONAL ONE PER CENTUM
 ANNUALLY, ADDED TO THE  APPLICABLE  SALARY  USED  FOR  THE  PURPOSES  OF
 COMPUTING  PENSION  BENEFITS  UNDER  THE PLAN IN WHICH THEY ARE ENROLLED
 WITH THE NEW YORK CITY FIRE PENSION FUND, PROVIDED,  HOWEVER,  THAT  THE
 COMBINED TOTAL ADDITIONAL CREDIT SHALL NOT EXCEED FIFTEEN PER CENTUM AND
 SHALL  BE  CAPPED  UPON THE COMPLETION OF THIRTY-FIVE YEARS OF UNIFORMED
 SERVICE WITH THE DEPARTMENT.
   § 2. This act shall take effect immediately.
