 AN ACT to amend the penal law, in relation to establishing the crime  of
   private carrier package theft
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The penal law is amended by adding a new section 165.75  to
 read as follows:
 § 165.75 PRIVATE CARRIER PACKAGE THEFT.
   A  PERSON  IS GUILTY OF PRIVATE CARRIER PACKAGE THEFT WHEN SUCH PERSON
 INTENTIONALLY  STEALS,  TAKES  OR  UNLAWFULLY  POSSESSES   ANY   PACKAGE
 ENTRUSTED  TO A PRIVATE CARRIER, FROM THE CUSTODY OF A COMMERCIAL CARRI-
 ER, INCLUDING FROM A COMMERCIAL CARRIER VEHICLE, OR FROM ANY  DESIGNATED
 DELIVERY LOCATION INCLUDING, BUT NOT LIMITED TO, A PACKAGE LOCKER, PACK-
 AGE  ROOM,  PORCH,  DOORSTEP, DOORWAY, VESTIBULE OR LOBBY, INCLUDING ANY
 SUCH PACKAGE THAT IS IN TRANSIT, THAT HAS BEEN PLACED  AT  THE  INTENDED
 DELIVERY  LOCATION,  OR  THAT  HAS  BEEN  LEFT FOR SCHEDULED PICKUP BY A
 COMMERCIAL CARRIER, BEFORE SUCH PACKAGE HAS BEEN  LAWFULLY  RECEIVED  BY
 THE INTENDED RECIPIENT OR AN AUTHORIZED RECIPIENT OF SUCH PACKAGE.
   PRIVATE CARRIER PACKAGE THEFT IS A CLASS E FELONY PUNISHABLE BY A FINE
 OF NOT MORE THAN TWO HUNDRED FIFTY THOUSAND DOLLARS.
   §  2. Section 80.00 of the penal law is amended by adding a new subdi-
 vision 8 to read as follows:
   8. NOTWITHSTANDING ANY INCONSISTENT PROVISION OF  SUBDIVISION  ONE  OF
 THIS  SECTION,  THE  COURT  MAY IMPOSE A FINE FOR A VIOLATION OF SECTION
 165.75 OF THIS CHAPTER IN AN AMOUNT NOT  TO  EXCEED  TWO  HUNDRED  FIFTY
 THOUSAND DOLLARS.
   § 3. This act shall take effect on the first of November next succeed-
 ing the date on which it shall have become a law.
