 Introduced  by Sen. GALLIVAN -- read twice and ordered printed, and when
   printed to be committed to the Committee on Environmental Conservation
 
 AN ACT to amend the  environmental  conservation  law,  in  relation  to
   removing  requirements that a parent, guardian or person and the minor
   remain at ground level at all times while deer hunting
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Paragraph  (b) of subdivision 1 of section 11-0935 of the
 environmental conservation law, as added by section  1  of  part  ZZ  of
 chapter 55 of the laws of 2021, is amended to read as follows:
   (b)  such  parent,  guardian or person has had at least three [year's]
 YEARS' experience in hunting deer; and
   (i) such parent, guardian or person holds a hunting license; and
   (ii) such parent, guardian or person maintains physical  control  over
 the minor at all times while hunting. For the purposes of this paragraph
 "physical  control" shall mean that the physical proximity of such minor
 to the parent, guardian or person is such that the parent,  guardian  or
 person  is  reasonably able to issue verbal directions and instructions,
 maintain constant visual contact, and  otherwise  provide  guidance  and
 supervision to the minor; and
   [(iii)  such parent, guardian or person and the minor remain at ground
 level at all times while hunting; and]
   § 2. This act shall take effect immediately; provided,  however,  that
 the  amendments made to subdivision 1 of section 11-0935 of the environ-
 mental conservation law made by section one of this act shall not affect
 the repeal of such section and shall be deemed repealed therewith.
