 Introduced  by  Sen. PALUMBO -- read twice and ordered printed, and when
   printed to be committed to the Committee on Health
 
 AN ACT to amend the public health law, in relation to requests for birth
   certificates
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1. Subdivision 2 of section 4173 of the public health law, as
 amended by section 30 of part L of chapter 56 of the laws  of  2015,  is
 amended to read as follows:
   2. A certified copy or certified transcript of a birth record shall be
 issued  only  upon  order of a court of competent jurisdiction or upon a
 specific request therefor by the person, if eighteen  years  of  age  or
 more,  or  by  a  parent or other lawful representative of the person to
 whom the record of birth relates including an authorized  representative
 of the office of children and family services or a local social services
 district if the person is in the care and custody or custody and guardi-
 anship  of  such entity, OR UPON A SPECIFIC REQUEST THEREFOR BY A PERSON
 WITH A DIRECT INTEREST IN THE CONTENT OF THE BIRTH RECORD AND  THAT  THE
 INFORMATION  CONTAINED  THEREIN  IS  NECESSARY  FOR THE DETERMINATION OF
 PERSONAL OR PROPERTY RIGHT AS DETERMINED BY THE  REGISTRAR  UNDER  REGU-
 LATIONS PRESCRIBED BY THE COMMISSIONER.
   § 2. This act shall take effect immediately.
