TITLE OF BILL:

An act to amend the correction law, in relation to removing the fee for
a sex offender to make a change to such sex offender's registration with
the division of criminal justice services

 
PURPOSE:

To remove the fee for an individual registered as a sex offender to make
a change to their registration with the Division of Criminal Justice
Services.

 
SUMMARY OF PROVISIONS:

Section 1 offers an amendment on Subdivision 4 of section 168-f of the
correction law, as amended by chapter 67 of the laws of 2008.

Section 2 provides an effective-date.

 
JUSTIFICATION:

Currently, sex offenders are required to pay 10 dollars to change any
aspect of their registration. This restriction places an undue burden on
sex offenders that are required by law to document their address changes
whether it be residence or employment.

The fee is an extraneous amount to ask for and may prevent people from
reporting new address changes due to a lack of funds. This is especially
true for those on the registry that are without permanent homes and
struggle to find permanent placement due to residency restrictions. This
population also struggled with steady employment as the types of jobs
and where they can work is extremely limited due to registry require-
ments.

The elimination of this fee would ultimately get rid of this burden, as
well as allow individuals registered as sex offenders to update their
registration as soon and as often as possible for the most up-to-date
information.

 AN ACT to amend the correction law, in relation to removing the fee  for
   a  sex  offender  to make a change to such sex offender's registration
   with the division of criminal justice services

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision  4 of section 168-f of the correction law, as
 amended by chapter 67 of the  laws  of  2008,  is  amended  to  read  as
 follows:
   4. Any sex offender shall register with the division no later than ten
 calendar days after any change of address, internet accounts with inter-
 net  access  providers  belonging to such offender, internet identifiers
 that such offender uses, or [his  or  her]  SUCH  OFFENDER'S  status  of
 enrollment,  attendance,  employment  or residence at any institution of
 higher education. [A fee of ten dollars, as  authorized  by  subdivision
 eight  of  section  one  hundred sixty-eight-b of this article, shall be
 submitted by the sex offender each  time  such  offender  registers  any
 change  of  address  or  any  change of his or her status of enrollment,
 attendance, employment or residence at any institution of higher  educa-
 tion.  Any  failure  or  omission  to  submit the required fee shall not
 affect the acceptance by the division of the change of address or change
 of status.] NO FEE SHALL BE COLLECTED FROM A SEX OFFENDER  IN  ORDER  TO
 CHANGE  THEIR  ADDRESS,  OR  ANY CHANGE TO SUCH SEX OFFENDER'S STATUS OF
 ENROLLMENT, ATTENDANCE, EMPLOYMENT OR RESIDENCE AT  ANY  INSTITUTION  OF
 HIGHER EDUCATION.
   § 2. This act shall take effect immediately.
