 Introduced  by  Sens. COMRIE, SALAZAR -- read twice and ordered printed,
   and when printed to be committed to the Committee  on  New  York  City
   Education
 
 AN  ACT  to amend the education law, in relation to prohibiting co-loca-
   tion of a charter school in a public school building in a city  school
   district in a city having a population of one million or more inhabit-
   ants;  and  to  repeal certain provisions of the education law related
   thereto
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Paragraphs (a-3), (a-4), (a-5), (d) and (e) of subdivision
 3 of section 2853 of the education law are REPEALED and a new  paragraph
 (d) is added to read as follows:
   (D)  NOTWITHSTANDING  ANY  OTHER  PROVISION OF LAW TO THE CONTRARY, NO
 CHARTER SCHOOL SHALL BE CO-LOCATED IN A PUBLIC SCHOOL BUILDING IN A CITY
 SCHOOL DISTRICT IN A CITY HAVING A POPULATION OF  ONE  MILLION  OR  MORE
 INHABITANTS.
   §  2.  This act shall take effect on the first of July next succeeding
 the date on which it shall have become a law.
