TITLE OF BILL:

An act to amend the executive law, in relation to requiring discrimi-
nation, bias, and harassment prevention training for members of state
boards and commissions

 
PURPOSE:

This legislation would require each member of a state board or commis-
sion, regardless of compensation, to complete discrimination, bias, and
harassment prevention training on an annual basis.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1 amends the executive law by adding a new section 170-f requir-
ing each member of a state board or commission, whether or not the
member is compensated, to complete discrimination, bias, and harassment
prevention training on an annual basis.

              

Section 2 establishes an effective date for the act as the ninetieth day
after it shall have become law. Effective immediately, the addition,
amendment and/or repeal of any rule or regulation necessary for the
implementation of this act on its effective date are authorized to be
made and completed on or before-such effective date.

 
JUSTIFICATION:

Beginning in 2018, all private and public employers in the state were
required to conduct annual anti-harassment training for all employees
and distribute a written anti-harassment policy. While paid state
employees and paid board members and commissioners are required to take
this training, unpaid members of boards and commissions are not.  This
legislation would resolve this disparity and ensure all members of state
boards and commissions, regardless of compensation, receive the same
training.

EFFECTIVE DATE:
This act shall take effect on the ninetieth day after it shall have
become law. Effective immediately, the addition, amendment, and/or
repeal of any rule or regulation necessary for the implementation of
this act on its effective date are authorized to be made and completed
on or before such effective date.
