AN ACT directing the department of transportation to conduct a study to
evaluate the standard approach of setting or adjusting speed limits
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The department of transportation shall conduct a study to
evaluate the standard approach to setting or adjusting speed limits in
New York state, including:
(a) assessing all factors for setting or adjusting the speed limit;
(b) assessing the usage of 85th percentile rule in setting or adjust-
ing the speed limit;
(c) evaluating the application of 85th percentile rule in setting or
adjusting the speed limit and its correlation with traffic crashes; and
(d) evaluating alternative methods of 85th percentile rule to set or
adjust speed limits with better impact (correlation) on preventing traf-
fic crashes and provide recommendations on those alternative methods.
§ 2. For purposes of this act, "85th percentile rule" shall mean the
speed at or below which 85 percent of all vehicles are traveling under
free-flowing conditions.
§ 3. Within one year of the effective date of this act the department
of transportation shall publish a report with the findings and recommen-
dations of the study in a clear and conspicuous location on its website
and shall deliver a copy to the legislature.
§ 4. This act shall take effect immediately.
