 AN ACT to amend the executive law, in  relation  to  reporting  of  hate
   crimes by law enforcement departments
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. This act shall be known and may be cited as the "hate crime
 accountability and transparency enforcement (HATE) reporting  act".
   § 2. The executive law is amended by adding a  new  section  837-y  to
 read as follows:
   §  837-Y. REPORTING DUTIES OF LAW ENFORCEMENT DEPARTMENTS WITH RESPECT
 TO HATE CRIMES.  1. THE CHIEF OF EVERY POLICE  DEPARTMENT,  EACH  COUNTY
 SHERIFF,  AND  THE  SUPERINTENDENT  OF  STATE  POLICE SHALL REPORT, IN A
 MANNER AND TIMEFRAME AS DETERMINED BY  THE  DIVISION,  ANY  INSTANCE  OR
 OCCURRENCE  IN  WHICH  A HATE CRIME, AS DEFINED IN SECTION 485.05 OF THE
 PENAL LAW, IS REPORTED OR INVESTIGATED.   THE DIVISION  SHALL  USE  SUCH
 REPORTS  FOR THE PURPOSE OF PROVIDING DATA TO FEDERAL BUREAUS OR DEPART-
 MENTS ENGAGED IN COLLECTING NATIONAL CRIMINAL STATISTICS, INCLUDING  BUT
 NOT LIMITED TO THE FEDERAL BUREAU OF INVESTIGATION.
   2.  THE  DIVISION SHALL PROMULGATE RULES AND REGULATIONS TO EFFECTUATE
 THE REPORTING OF HATE CRIME DATA TO  THE  DIVISION  BY  LAW  ENFORCEMENT
 DEPARTMENTS AS REQUIRED PURSUANT TO SUBDIVISION ONE OF THIS SECTION SUCH
 THAT  THE  DIVISION  MAY  PROVIDE  HATE CRIME DATA TO FEDERAL BUREAUS OR
 DEPARTMENTS ENGAGED IN COLLECTING NATIONAL CRIMINAL STATISTICS,  INCLUD-
 ING BUT NOT LIMITED TO THE FEDERAL BUREAU OF INVESTIGATION.
   § 3. This act shall take effect January 1, 2026.

 BLY, DO ENACT AS FOLLOWS:

 AS  DEFINED  IN SECTION 485.05 OF THE PENAL LAW, IS REPORTED OR INVESTI-
 GATED.  SUCH REPORTS SHALL BE TRANSMITTED TO THE  DIVISION  SUCH    THAT
 THE DIVISION  MAY  PROVIDE SUCH HATE CRIME DATA TO THE FEDERAL BUREAU OF
 INVESTIGATION  IN  A  MANNER  CONSISTENT  WITH  THE  REQUIREMENTS OF THE
 NATIONAL INCIDENT-BASED REPORTING SYSTEM.
   2. THE DIVISION SHALL PROMULGATE RULES AND REGULATIONS  TO  EFFECTUATE
 THE  REPORTING  OF  HATE  CRIME  DATA TO THE DIVISION BY LAW ENFORCEMENT
 DEPARTMENTS AS REQUIRED PURSUANT TO SUBDIVISION ONE OF THIS SECTION.
