TITLE OF BILL:

An act to amend the executive law, in relation to requiring that when a
complaint is made to local code enforcement of a violation of the
uniform fire prevention and building code which results in the issuance
of a compliance order, the complainant shall also be provided a copy of
such order

 
PURPOSE:

The purpose of this bill is to require that in the event a complaint is
made to local code enforcement, which results in the issuance of a
compliance order, then the complainant shall also be provided a copy of
such order.

 
SUMMARY OF PROVISIONS:

Section 1: Amends paragraph (h) and (i) of section 381 of the Executive
Law to include minimum basic training and in-service training require-

ments must be established for personnel responsible for administering
and enforcing the state energy conservation construction code. Addi-
tionally, standards and procedures must be in place to measure compli-
ance with the code annually. It further remedies a violation of the
uniform fire prevention and building code, the order must be delivered
in person or by registered or certified mail to the complainant who
initially reported the violation.

Section 2: Amends paragraph (i) and (j) of subdivision 1 of section
381(1) of the Executive Law, to include an order under 19 NYCRR 1202.5
to remedy a violation of the uniform fire prevention and building code,
the order must be delivered in person or by registered or certified mail
to the complainant. Additionally, standards and procedures must be
established to measure compliance with the state energy conservation
construction code annually. While having procedures requiring documenta-
tion of compliance with regulations under section 1377 of the public
health law as a condition for issuing a certificate of occupancy or
compliance after periodic fire safety and property maintenance
inspections for multiple dwellings.

Section 3: Amends subdivision 1 of section 382 of the executive law, to
provide that a copy of the relevant compliance order be issued by mail
when an alleged violation was found and directed to be remedied.

Section 4: Sets Effective Date.

 
JUSTIFICATION:

This bill aims to enhance tenant protections by increasing transparency
within the code enforcement system, ensuring that absentee and negligent
landlords are held accountable for housing violations. Currently,
tenants who file complaints often receive no follow-up regarding the
outcome of their report they are not informed whether a violation was
identified, what corrective measures were mandated, or the deadline for
compliance. Under existing law, violation orders are only required to be
provided to landlords, leaving tenants in the dark about the status of
their complaint.
By mandating that complainants also receive copies of violation orders,
this legislation will improve transparency, bolster public confidence in
the enforcement process, and empower tenants to advocate for safe living
conditions. Providing tenants with this information will also enhance
accountability, as those directly affected by hazardous housing condi-
tions will be able to monitor compliance and notify local authorities if
a landlord fails to remedy a violation within the prescribed timeframe.

This bill builds upon recent legislative efforts to deter chronic code
violations, including the imposition of higher fines on repeat offen-
ders. By strengthening enforcement mechanisms and improving tenant
access to critical information, this measure will further ensure that
all New Yorkers have access to safe and habitable housing.

EFFECTIVE DATE:
This act shall take effect immediately; provided, however, that section
two of this act shall take effect on the same date and in the same

 AN  ACT to amend the executive law, in relation to requiring that when a
   complaint is made to local code enforcement  of  a  violation  of  the
   uniform  fire  prevention and building code which results in the issu-
   ance of a compliance order, the complainant shall also be  provided  a

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Paragraphs h and i of subdivision 1 of section 381  of  the
 executive  law, as added by chapter 560 of the laws of 2010, are amended
 and a new paragraph j is added to read as follows:
   h. minimum basic training and  in-service  training  requirements  for
 personnel charged with administration and enforcement of the state ener-
 gy conservation construction code; [and]
   i.  standards and procedures for measuring the rate of compliance with
 the state energy conservation construction code, and provisions  requir-
 ing that such rate of compliance be measured on an annual basis[.];
   J.  IN  THE  EVENT  A  COMPLAINT  IS MADE TO A LOCAL GOVERNMENT OR THE
 SECRETARY WHICH RESULTS IN THE ISSUANCE OF AN ORDER IN  ACCORDANCE  WITH
 19  NYCRR 1202.5 TO REMEDY ANY CONDITION FOUND TO EXIST IN, ON, OR ABOUT
 ANY BUILDING IN VIOLATION OF THE UNIFORM FIRE  PREVENTION  AND  BUILDING
 CODE,  PROVIDING  OF  SUCH ORDER IN PERSON OR BY REGISTERED OR CERTIFIED
 MAIL TO THE COMPLAINANT WHO INITIALLY REPORTED SUCH VIOLATION.

 power to order in writing the remedying of any condition found to  exist
 in, on or about any building in violation of the uniform fire prevention
 and  building code and to issue appearance tickets for violations of the
 uniform code.  A COPY OF AN ORDER SERVED PURSUANT TO THIS SUBDIVISION OR
 19 NYCRR 1202.5 SHALL ALSO BE PROVIDED TO A  COMPLAINANT  IN  ACCORDANCE
 WITH  THE  MINIMUM  RULES  AND  REGULATIONS ESTABLISHED BY THE SECRETARY
 PURSUANT TO PARAGRAPH K OF SUBDIVISION  ONE  OF  SECTION  THREE  HUNDRED
 EIGHTY-ONE  OF  THIS  ARTICLE, IF SUCH ORDER WAS ISSUED AS A RESULT OF A
 COMPLAINT MADE BY AN INDIVIDUAL.
   § 4. This act shall take effect immediately; provided,  however,  that
 section  two  of  this act shall take effect on the same date and in the

 Introduced  by  Sen. SKOUFIS -- read twice and ordered printed, and when
   printed to be committed to the Committee on Housing, Construction  and
   Community  Development  --  reported  favorably  from  said committee,
   ordered to first and  second  report,  ordered  to  a  third  reading,
   amended  and  ordered  reprinted,  retaining its place in the order of
   third reading -- recommitted to the Committee on Housing, Construction
   and Community Development in accordance with Senate Rule 6, sec. 8  --
   reported  favorably  from  said committee, ordered to first and second
   report, ordered to a third reading,  amended  and  ordered  reprinted,
   retaining its place in the order of third reading
 
 AN  ACT to amend the executive law, in relation to requiring that when a
   complaint is made to local code enforcement  of  a  violation  of  the
   uniform  fire  prevention  and  building  code or local building codes
   which results in the issuance of a compliance order,  the  complainant
   shall also be provided a copy of such order
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Paragraphs h and i of subdivision 1 of section 381  of  the
 executive  law, as added by chapter 560 of the laws of 2010, are amended
 and a new paragraph j is added to read as follows:
   h. minimum basic training and  in-service  training  requirements  for
 personnel charged with administration and enforcement of the state ener-
 gy conservation construction code; [and]
   i.  standards and procedures for measuring the rate of compliance with
 the state energy conservation construction code, and provisions  requir-
 ing that such rate of compliance be measured on an annual basis[.];
   J.  IN  THE  EVENT  A  COMPLAINT  IS MADE TO A LOCAL GOVERNMENT OR THE
 SECRETARY WHICH RESULTS IN THE ISSUANCE OF AN ORDER IN  ACCORDANCE  WITH
 ANY  REGULATIONS  PROMULGATED  BY  THE  POWERS  GRANTED BY SECTION THREE
 HUNDRED SEVENTY-SEVEN OF THIS ARTICLE OR SECTION THREE HUNDRED  SEVENTY-
 NINE  OF  THIS ARTICLE TO REMEDY ANY CONDITION FOUND TO EXIST IN, ON, OR
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

 ABOUT ANY BUILDING IN VIOLATION OF ANY REGULATIONS  PROMULGATED  BY  THE
 POWERS GRANTED BY SECTION THREE HUNDRED SEVENTY-SEVEN OF THIS ARTICLE OR
 SECTION  THREE  HUNDRED  SEVENTY-NINE OF THIS ARTICLE, PROVIDING OF SUCH
 ORDER  IN  PERSON  OR BY REGISTERED OR CERTIFIED MAIL TO THE COMPLAINANT
 WHO INITIALLY REPORTED SUCH VIOLATION.
   § 2. Paragraphs i and j of subdivision 1 of section 381 of the  execu-
 tive  law,  paragraph i as amended and paragraph j as added by section 3
 of part T of chapter 57 of the laws of 2023, are amended and a new para-
 graph k is added to read as follows:
   i. standards and procedures for measuring the rate of compliance  with
 the  state energy conservation construction code, and provisions requir-
 ing that such rate of compliance be measured on an annual basis; [and]
   j. procedures requiring the documentation  of  compliance  with  regu-
 lations  adopted  pursuant  to section thirteen hundred seventy-seven of
 the public health law as a condition to issuance  of  a  certificate  of
 occupancy  or certificate of compliance following a periodic fire safety
 and property maintenance inspection for multiple dwellings[.];
   K. IN THE EVENT A COMPLAINT IS MADE  TO  A  LOCAL  GOVERNMENT  OR  THE
 SECRETARY  WHICH  RESULTS IN THE ISSUANCE OF AN ORDER IN ACCORDANCE WITH
 ANY REGULATIONS PROMULGATED BY  THE  POWERS  GRANTED  BY  SECTION  THREE
 HUNDRED  SEVENTY-SEVEN OF THIS ARTICLE OR SECTION THREE HUNDRED SEVENTY-
 NINE OF THIS ARTICLE TO REMEDY ANY CONDITION FOUND TO EXIST IN,  ON,  OR
 ABOUT  ANY  BUILDING  IN VIOLATION OF ANY REGULATIONS PROMULGATED BY THE
 POWERS GRANTED BY SECTION THREE HUNDRED SEVENTY-SEVEN OF THIS ARTICLE OR
 SECTION THREE HUNDRED SEVENTY-NINE OF THIS ARTICLE,  PROVIDING  OF  SUCH
 ORDER  IN  PERSON  OR BY REGISTERED OR CERTIFIED MAIL TO THE COMPLAINANT
 WHO INITIALLY REPORTED SUCH VIOLATION.
   § 3. Subdivision 1 of section 382 of the executive law,  as  added  by
 chapter 707 of the laws of 1981, is amended to read as follows:
   1. In addition to and not in limitation of any power otherwise granted
 by  law, every local government and its authorized agents shall have the
 power to order in writing the remedying of any condition found to  exist
 in, on or about any building in violation of the uniform fire prevention
 and  building code and to issue appearance tickets for violations of the
 uniform code.  A COPY OF AN ORDER SERVED PURSUANT TO THIS SUBDIVISION OR
 ANY REGULATIONS PROMULGATED BY  THE  POWERS  GRANTED  BY  SECTION  THREE
 HUNDRED  SEVENTY-SEVEN OF THIS ARTICLE OR SECTION THREE HUNDRED SEVENTY-
 NINE OF THIS ARTICLE SHALL ALSO BE PROVIDED TO A COMPLAINANT IN  ACCORD-
 ANCE WITH THE RULES AND REGULATIONS ESTABLISHED UNDER THE POWERS GRANTED
 BY  SECTION THREE HUNDRED SEVENTY-SEVEN OF THIS ARTICLE OR SECTION THREE
 HUNDRED SEVENTY-NINE OF THIS ARTICLE, PURSUANT TO PARAGRAPH K OF  SUBDI-
 VISION  ONE OF SECTION THREE HUNDRED EIGHTY-ONE OF THIS ARTICLE, IF SUCH
 ORDER WAS ISSUED AS A RESULT OF A COMPLAINT MADE BY AN INDIVIDUAL.
   § 4. This act shall take effect on the one hundred eightieth day after
 it shall have become a law; provided, however, that if section 3 of part
 T of chapter 57 of the laws of 2023 shall not have taken  effect  on  or
 before  such  date then section two of this act shall take effect on the
 same date and in the same manner as such section, takes effect.
