TITLE OF BILL:
An act to amend the executive law, in relation to prohibiting employers
from seeking graduation dates from prospective employees
PURPOSE:
The purpose of this legislation is to address the rampant age discrimi-
nation that occurs during the hiring process.
SUMMARY OF PROVISIONS:
Section 1 adds a new subdivision 20 to Section 296 of the Executive Law
that makes it unlawful for hiring entities or their employees or agents
to inquire about the high school, college, or graduate program gradu-
ation dates of prospective employees during the hiring process.
Section 2 is the effective date.

AN ACT to amend the executive law, in relation to prohibiting employers
from seeking graduation dates from prospective employees
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 296 of the executive law is amended by adding a new
subdivision 20 to read as follows:
20. IT SHALL BE AN UNLAWFUL DISCRIMINATORY PRACTICE OF ANY EMPLOYER,
LABOR ORGANIZATION, EMPLOYMENT AGENCY OR LICENSING AGENCY, OR EMPLOYEES
OR AGENTS THEREOF, TO SEEK HIGH SCHOOL, COLLEGE OR GRADUATE PROGRAM
GRADUATION DATES FROM A PROSPECTIVE EMPLOYEE FOR AN INTERVIEW OR AS A
CONDITION FOR EMPLOYMENT.
§ 2. This act shall take effect on the ninetieth day after it shall
have become a law.
