BILL NUMBER: S6886 SPONSOR: HARCKHAM TITLE OF BILL: An act to amend the insurance law, in relation to setting minimum reimbursement for mobile crisis intervention services PURPOSE: Establishes a minimum reimbursement rate for mobile crisis services that adheres to current rates under the medical assistance program. SUMMARY OF PROVISIONS: Section 1 amends subparagraph (I) of paragraph 35 of subsection (i) of section 3216 of the insurance law by adding a new item to provide a minimum reimbursement for mobile crisis intervention services. Section 2 amends Subparagraph (I) of paragraph 5 of subsection (1) of section 3221 of the insurance law by adding a new item (vi) minimum reimbursement for mobile crisis intervention services.

HARCKHAM -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the insurance law, in relation to setting minimum reimbursement for mobile crisis intervention services THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph (I) of paragraph 35 of subsection (i) of section 3216 of the insurance law is amended by adding a new item (vi) to read as follows: (VI) REIMBURSEMENT FOR COVERED SERVICES PROVIDED BY A MOBILE CRISIS INTERVENTION SERVICES PROVIDER SHALL BE AT A RATE THAT IS NOT LESS THAN THE RATE THAT WOULD BE PAID FOR SUCH SERVICES PURSUANT TO THE MEDICAL ASSISTANCE PROGRAM UNDER TITLE ELEVEN OF ARTICLE FIVE OF THE SOCIAL SERVICES LAW. § 2. Subparagraph (I) of paragraph 5 of subsection (l) of section 3221 of the insurance law is amended by adding a new item (vi) to read as follows: (VI) REIMBURSEMENT FOR COVERED SERVICES PROVIDED BY A MOBILE CRISIS INTERVENTION SERVICES PROVIDER SHALL BE AT A RATE THAT IS NOT LESS THAN THE RATE THAT WOULD BE PAID FOR SUCH SERVICES PURSUANT TO THE MEDICAL ASSISTANCE PROGRAM UNDER TITLE ELEVEN OF ARTICLE FIVE OF THE SOCIAL SERVICES LAW. § 3. Paragraph 10 of subsection (g) of section 4303 of the insurance law is amended by adding a new subparagraph (F) to read as follows: (F) REIMBURSEMENT FOR COVERED SERVICES PROVIDED BY A MOBILE CRISIS INTERVENTION SERVICES PROVIDER SHALL BE AT A RATE THAT IS NOT LESS THAN THE RATE THAT WOULD BE PAID FOR SUCH SERVICES PURSUANT TO THE MEDICAL ASSISTANCE PROGRAM UNDER TITLE ELEVEN OF ARTICLE FIVE OF THE SOCIAL SERVICES LAW. § 4. This act shall take effect on the same date and in the same manner as subpart A of part II of chapter 57 of the laws of 2023, takes effect, and shall apply to policies and contracts issued, renewed, modi- fied, altered, or amended on and after such date.
