BILL NUMBER: S7178 SPONSOR: CLEARE TITLE OF BILL: An act to amend the general business law, in relation to establishing a private right of action for milk price gouging PURPOSE: To expand the ability of those affected by price gouging of milk to file a lawsuit from the attorney to all private citizens. SUMMARY OF PROVISIONS: Section 1 sets forth that any individual damaged by a violation of section 396-rr may bring an action for recovery of damage, and sets guidelines for allowed compensation. Section 2 provides that this subdivision does not nullify any rights an individual may have against a person at common law.

CLEARE -- read twice and ordered printed, and when printed to be committed to the Committee on Agriculture AN ACT to amend the general business law, in relation to establishing a private right of action for milk price gouging THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 396-rr of the general business law is amended by adding a new subdivision 7 to read as follows: 7. (A) ANY INDIVIDUAL DAMAGED BY A VIOLATION OF THIS SECTION MAY BRING AN ACTION FOR RECOVERY OF DAMAGES. JUDGMENT MAY BE ENTERED IN AN AMOUNT NOT TO EXCEED THREE TIMES THE ACTUAL DAMAGES PLUS REASONABLE ATTORNEY FEES. (B) NOTHING IN THIS SUBDIVISION SHALL BE CONSTRUED SO AS TO NULLIFY OR IMPAIR ANY RIGHT OR RIGHTS WHICH AN INDIVIDUAL MAY HAVE AGAINST A PERSON AT COMMON LAW, BY STATUTE, OR OTHERWISE. § 2.
