 AN ACT  to  amend  the  public  health  law,  in  relation  to  enhanced
   reimbursement  rates  for  pediatric practices that are partnered with
   the HealthySteps program

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Legislative intent. In order to improve quality and promote
 access  to  whole-child care, it is the policy of the state to encourage
 HealthySteps implementation in pediatric practices for  the  purpose  of
 increasing  access  to  evidenced-based screenings, health promotion and
 prevention services, and connections to supports for the family.
   § 2. Section 2807 of the public health law is amended by adding a  new
 subdivision 22 to read as follows:
   22.  (A)  NOTWITHSTANDING  ANY PROVISION OF LAW, RULE OR REGULATION TO
 THE CONTRARY, AND SUBJECT TO THE PROVISIONS OF  PARAGRAPH  (B)  OF  THIS
 SUBDIVISION  AND TO THE AVAILABILITY OF FEDERAL FINANCIAL PARTICIPATION,
 THE COMMISSIONER SHALL ESTABLISH OR APPROVE AN ENHANCED RATE METHODOLOGY
 FOR  PEDIATRIC  PRACTICES  THAT  ARE  PARTNERED  WITH  THE  HEALTHYSTEPS
 PROGRAM,  FOR  THE PURPOSES OF ADVANCING PEDIATRIC SCREENINGS, PROMOTION
 OF BEHAVIORAL HEALTH, AND PREVENTION AND TREATMENT OF BEHAVIORAL  HEALTH
 ISSUES IN CHILDREN.
   (B)  TO  BE  ELIGIBLE FOR THE ENHANCED RATE METHODOLOGY ESTABLISHED OR
 APPROVED PURSUANT TO PARAGRAPH (A)  OF  THIS  SUBDIVISION,  A  PEDIATRIC
 PRACTICE  THAT  IS  PARTNERED  WITH  THE HEALTHYSTEPS PROGRAM SHALL HAVE
 PROCESS AND OUTCOME STANDARDS THAT MEET OR EXCEED HEALTHYSTEPS  PROGRAM-
 SPECIFIC FIDELITY CRITERIA.
   (C)  FOR  THE  PURPOSES OF THIS SUBDIVISION, THE FOLLOWING TERMS SHALL
 HAVE THE FOLLOWING MEANINGS:
   (I) "PEDIATRIC PRACTICE" MEANS A PROVIDER PROVIDING PEDIATRIC CARE, AS
 DEFINED BY SECTION THREE THOUSAND SEVENTY-THREE OF THIS CHAPTER.

 AN ACT to amend the public health law, in relation to add-on payment for
   pediatric practices that implement the HealthySteps model

 THYSTEPS PAYMENT ADD-ON SHALL BE PAID IN ADDITION TO THE HEALTH CENTER'S
 PROSPECTIVE PAYMENT SYSTEM RATE OR PAYMENTS RECEIVED UNDER THE AMBULATO-
 RY PATIENT GROUP REIMBURSEMENT  METHODOLOGY.  REVENUE  FROM  THE  ADD-ON
 SHALL  BE EXCLUDED FROM MANAGED CARE VISIT AND REVENUE REPORTS AND SHALL
 NOT BE CONSIDERED IN THE CALCULATION OR  DETERMINATION  OF  SUPPLEMENTAL
 WRAP-AROUND PAYMENTS.
