BILL NUMBER: S7902 SPONSOR: JACKSON TITLE OF BILL: An act to amend the general business law and the vehicle and traffic law, in relation to used automotive parts PURPOSE: To ensure the reduction of auto part theft from vehicles by requiring provenance of automotive parts, which increases verifiability of origins and accountable ownership history. SUMMARY OF PROVISIONS: Section 1 amends the general business law by adding a new article 11-C that defines "used automotive parts", "private sales", and "exemptions", states their purpose, and authorizes the attorney general to oversee compliance and prosecute violations covered by the provisions of this section.

JACKSON -- read twice and ordered printed, and when printed to be committed to the Committee on Consumer Protection AN ACT to amend the general business law and the vehicle and traffic law, in relation to used automotive parts THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general business law is amended by adding a new article 11-D to read as follows: ARTICLE 11-D USED AUTOMOTIVE PARTS SECTION 199-Q. DEFINITIONS. 199-Q-1. USED AUTOMOTIVE PARTS. 199-Q-2. PRIVATE SALES. 199-Q-3. EXEMPTIONS. § 199-Q. DEFINITIONS. AS USED IN THIS ARTICLE, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS: 1. "MOTOR VEHICLE REPAIR SHOP" SHALL HAVE THE SAME MEANING AS SUCH TERM IS DEFINED IN SECTION THREE HUNDRED NINETY-EIGHT-B OF THE VEHICLE AND TRAFFIC LAW. 2. "VEHICLE DISMANTLER" SHALL HAVE THE SAME MEANING AS SUCH TERM IS DEFINED IN SECTION FOUR HUNDRED FIFTEEN-A OF THE VEHICLE AND TRAFFIC LAW. 3. "USED AUTOMOTIVE PART" SHALL MEAN A PART OF A MOTOR VEHICLE THAT WAS PREVIOUSLY INSTALLED ON A MOTOR VEHICLE AND THEN REMOVED. § 199-Q-1. USED AUTOMOTIVE PARTS. 1. ANY PERSON, BUSINESS, OR ENTITY ENGAGED IN THE SALE, INSTALLATION, OR USE OF USED AUTOMOTIVE PARTS, INCLUDING BUT NOT LIMITED TO MOTOR VEHICLE REPAIR SHOPS AND VEHICLE DISMANTLERS, SHALL MAINTAIN FOR NO LESS THAN TWO YEARS AND, UPON REQUEST, MAKE AVAILABLE FOR INSPECTION BY REGULATORY OR LAW ENFORCEMENT AGENCIES: EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
