TITLE OF BILL:

An act to amend the public authorities law, in relation to open data
reporting by the metropolitan transportation authority

 
PURPOSE OR GENERAL IDEA OF BILL:

Requires the MTA to publish an annual open data plan and annually update
its open data catalogue, codifying the MTA's existing practices. This
legislation also requires publication of open data related to customer
surveys and complaints, operating agency incident reports, and police
incidents and arrests, including by location.

 
SUMMARY OF PROVISIONS:

Section 1 amends subdivision 4 of section 1279-i of the public authori-
ties law to require the MTA to update its open data catalogue at a mini-
mum of annually, and to submit to the legislature and publish on its
website an annual open data plan. Additional data is required to be

published as open data by January 1, 2026, including customer surveys
and complaints, operating agency incident reports, and police incidents
and arrests. Data shall include operating agency, line, station, stop,
or other location, and for survey data or complaints, demographic infor-
mation submitted by customers.

Section 2 sets the effective date as immediately.

 
JUSTIFICATION:

The Metropolitan Transportation Authority (MTA) has made strides with
its open data program after passage of the MTA Open Data Law in 2021.
This legislation provides an update to the law to codify the MTA's prac-
tice of publishing an annual open data plan and updating its open data
catalogue at a minimum of annually.

The legislation also expands open data reporting requirements in three
key areas: customer survey data and complaints; incident reports as
collected by bus command and rail control centers; and police incident
and arrests. Importantly, this data is required to be disaggregated by
operating agency, line, station, bus stop, or other location. This new
data will allow the public and policymakers to better understand custom-
ers' concerns as well as conditions at individual stations and bus
stops, informing better targeting of resources.

 AN ACT to amend the public authorities law, in  relation  to  open  data
   reporting by the metropolitan transportation authority
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 4 of section 1279-i of the  public  authorities
 law,  as added by chapter 482 of the laws of 2021, is amended to read as
 follows:
   4. The authority and its subsidiaries and affiliates shall make  their
 publishable  MTA data available on its website and the open data website
 as follows:
   (a) The authority shall create a catalogue  of  publishable  MTA  data
 within  one  hundred  eighty days of the effective date of this section.
 SUCH CATALOGUE SHALL BE UPDATED AS NECESSARY, BUT AT A MINIMUM ANNUALLY;
   (b) The metropolitan transportation authority shall within one hundred
 eighty days of the effective date of this section, submit to the  legis-
 lature  and publish on its shared internet website a schedule for making
 its publishable MTA data publicly available. Such schedule shall provide
 for updating the data catalogue as appropriate; [and]
   (c) The metropolitan transportation authority shall  create  schedules
 for publishing all publishable MTA data within three years of the effec-
 tive date of this section[.];
   (D)  THE  METROPOLITAN  TRANSPORTATION  AUTHORITY  SHALL SUBMIT TO THE
 LEGISLATURE AND PUBLISH ON ITS SHARED INTERNET WEBSITE  AN  ANNUAL  OPEN
 DATA  PLAN  THAT  INCLUDES,  BUT IS NOT LIMITED TO, A LISTING OF THE NEW
 DATASETS PUBLISHED, A LISTING OF UPDATED DATASETS, AND INFORMATION ABOUT
 PUBLIC ENGAGEMENTS SESSIONS, NUMBER OF FULL TIME STAFF DEDICATED TO  THE
 OPEN  DATA INITIATIVE, AND PROGRESS MADE IN PUBLISHING DATASETS PURSUANT
 TO THE CATALOGUE REQUIRED BY THIS SECTION;

   (E)  THE  METROPOLITAN  TRANSPORTATION  AUTHORITY  SHALL  PUBLISH  ALL
 CUSTOMER  SURVEY AND COMPLAINT DATA COLLECTED BY THE AUTHORITY OR ANY OF
 ITS AFFILIATES AND SUBSIDIARIES AS REQUIRED BY  THIS  SECTION  NO  LATER
 THAN  JANUARY  FIRST,  TWO  THOUSAND TWENTY-SIX. SUCH PUBLISHED DATASETS
 SHALL  INCLUDE,  BUT NOT BE LIMITED TO, ANY TABULAR SUMMARY, QUANTIFICA-
 TION OR TABLE OF THE RESPONSES TO A SURVEY OR COMPLAINT DATA, THE NUMBER
 OF PARTICIPANTS OF ANY SUCH SURVEY, A LISTING OF ALL  SURVEY  QUESTIONS,
 THE  NUMBER  OF COMPLAINTS OR COMMENDATIONS RECEIVED EACH MONTH, AND THE
 TYPE OF COMPLAINT OR  COMMENDATION.  DATA  REGARDING  CUSTOMER  SURVEYS,
 CUSTOMER  SATISFACTION,  CLEANLINESS, COMPLAINTS, OR COMMENDATIONS SHALL
 INCLUDE THE OPERATING AGENCY, LINE, STATION, STOP OR OTHER LOCATION  THE
 CUSTOMER  RESPONSES  OR COMPLAINTS ARE REFERRING TO. SUCH DATASETS SHALL
 ALSO INCLUDE, BUT NOT BE LIMITED TO, ANY DEMOGRAPHIC DATA  SUBMITTED  BY
 CUSTOMERS OR COMPLAINANTS;
   (F)  THE METROPOLITAN TRANSPORTATION AUTHORITY SHALL PUBLISH ALL INCI-
 DENT REPORT DATA COLLECTED BY THE AUTHORITY OR ANY OF ITS AFFILIATES AND
 SUBSIDIARIES AS REQUIRED BY THIS SECTION NO LATER  THAN  JANUARY  FIRST,
 TWO  THOUSAND  TWENTY-SIX.  DATA  REGARDING  INCIDENTS SHALL INCLUDE THE
 OPERATING AGENCY, LINE, STATION,  STOP,  OR  OTHER  LOCATION  AND  SHALL
 INCLUDE  INCIDENT  DETAILS AS REPORTED TO OR BY THE BUS COMMAND AND RAIL
 CONTROL CENTERS; AND
   (G) THE METROPOLITAN TRANSPORTATION AUTHORITY SHALL PUBLISH ALL POLICE
 INCIDENT AND ARREST DATA COLLECTED BY THE AUTHORITY OR ANY OF ITS AFFIL-
 IATES AND SUBSIDIARIES AS REQUIRED BY THIS SECTION NO LATER THAN JANUARY
 FIRST, TWO THOUSAND TWENTY-SIX.  DATA  REGARDING  POLICE  INCIDENTS  AND
 ARRESTS SHALL INCLUDE THE OPERATING AGENCY, LINE, STATION, STOP OR OTHER
 LOCATION.
   § 2. This act shall take effect immediately.
