2025-S8019 (ACTIVE) - Summary

Increases the number of entities to whom the New York state energy research and development authority must submit an annual report; requires the report to include a brief summary of all proceeds collected and administered by the authority pursuant to an order of the public service commission or pursuant to regulation, including, but not limited to, assessments, fees, taxes, transfers, corporate income or surcharges imposed on energy consumers or power generators.

TITLE OF BILL:

An act to amend the public authorities law, in relation to the annual
reporting obligations of the New York state energy research and develop-
ment authority

 
PURPOSE OR GENERAL IDEA OF BILL:

The purpose of this bill is increase the accessibility and transparency
of information related to the New York State Energy Research and Devel-
opment Authority's (NYSERDA) funding.

 
SUMMARY OF PROVISIONS:

The changes to paragraph (a) of this section of law would require NYSER-
DA submit a report the Authority already prepares to the chairs of the
Assembly and Senate Energy Committees.

The addition of subparagraph seven requires NYSERDA to prepare a brief

summary of how funds approved by the Public Service Commission or pursu-
ant to regulation are used and include such summary in their semi-annual
report.

 
JUSTIFICATION:

NYSERDA's standing as a public authority allows it to accomplish many
goals of the state that would not be possible if it were a traditional
state agency. However, as a public authority NYSERDA's funding is not
subject to the traditional state budget process that state agencies are.
NYSERDA receives funding from a variety of sources including charges on
utilities approved by the Public Service Commission as well as the
Regional Greenhouse Gas Initiative, but since these funding sources
aren't subject to the state budget process NYSERDA is required to submit
a semi-annual report to the chairs of the legislative fiscal committees.
This bill would require those reports also be submitted to the chairs of
the Senate Energy and Telecommunications Committee and the Assembly
Energy Committee and include a brief summary of how these funds are
used. This will strengthen legislative oversight of NYSERDA and increase
transparency within state government.

 AN  ACT  to  amend the public authorities law, in relation to the annual
   reporting obligations of the New York state energy research and devel-
   opment authority

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Paragraphs (a) and (b) of subdivision 7 of section 1867 of
 the public authorities law, as added by section 1 of part RR of  chapter
 58 of the laws of 2015, is amended to read as follows:
   (a)  The  authority  shall  submit  to  the governor, the chair of the
 senate finance committee, [and] the chair of the assembly ways and means
 committee, THE CHAIR OF THE SENATE ENERGY AND TELECOMMUNICATIONS COMMIT-
 TEE, AND THE CHAIR OF THE ASSEMBLY ENERGY COMMITTEE, and publish on  the
 authority's  public  website  a  semi-annual  report for the time period
 ending March thirty-first no later than June  first  and  for  the  time
 period  ending  September thirtieth no later than December first of each
 year detailing the authority's activities for  the  previous  six  month
 reporting period.
   (b)  The semi-annual report required pursuant to paragraph (a) of this
 subdivision shall include  information  with  respect  to  all  proceeds
 collected  and administered by the authority pursuant to an order of the
 public service commission, including assessments,  fees,  taxes,  trans-
 fers,  corporate  income  or  surcharges  imposed on energy consumers or
 power generators. The semi-annual report shall include,  at  a  minimum,
 the following:
   1. total revenues collected by the authority in the reporting period;
   2.  a  list of requests for proposals, program opportunity notices, or
 similar solicitations, that have been issued in the reporting period;

   3. a description of the criteria and standards utilized for awarding a
 request for proposal, a program opportunity notice, or similar solicita-
 tion;
   4.  a  regional  report  on  all  projects selected for funding by the
 authority during the reporting period, including the county and  utility
 service  territory  in which the project is located, and the total value
 of these projects statewide and by region;
   5. all disbursements or expenditures of revenues pursuant to a request
 for proposal, a program opportunity  notice,  or  similar  solicitation;
 [and]
   6. a list of all contracts executed and completed during the reporting
 period including a description of each project; AND
   7.  A  BRIEF SUMMARY OF ALL PROCEEDS COLLECTED AND ADMINISTERED BY THE
 AUTHORITY PURSUANT TO AN ORDER  OF  THE  PUBLIC  SERVICE  COMMISSION  OR
 PURSUANT  TO  REGULATION,  INCLUDING,  BUT  NOT LIMITED TO, ASSESSMENTS,
 FEES, TAXES, TRANSFERS, CORPORATE INCOME OR SURCHARGES, IMPOSED ON ENER-
 GY CONSUMERS OR POWER GENERATORS,  INCLUDING  A  DESCRIPTION  AND  BASIC
 ACCOUNTING  OF  ALL PROGRAMS OPERATED BY THE AUTHORITY, EITHER INDEPEND-
 ENTLY OR JOINTLY WITH ANOTHER STATE ENTITY, THAT UTILIZE SUCH PROCEEDS.
   § 2. This act shall take effect on the first of January next  succeed-
 ing the date on which it shall have become a law.
