BILL NUMBER: S8282 SPONSOR: BORRELLO TITLE OF BILL: An act to amend the alcoholic beverage control law and the agriculture and markets law, in relation to authorizing retail licensees of liquor and/or wine for off-premises consumption to apply for licensure as a retail food store PURPOSE OR GENERAL IDEA OF BILL: This legislation would authorize retail licensees of liquor and/or wine for off-premises consumption to apply for a licensure as a retail food store. SUMMARY OF PROVISIONS: Section 1: Allows retail licensees authorized to sell liquor and/or wine for off-premises consumption to apply for a license as a retail food store. Such applications shall be processed in the same manner as those for retail food stores, food service establishments, or food warehouses

BORRELLO -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the alcoholic beverage control law and the agriculture and markets law, in relation to authorizing retail licensees of liquor and/or wine for off-premises consumption to apply for licensure as a retail food store THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The alcoholic beverage control law is amended by adding a new section 132 to read as follows: § 132. RETAIL LICENSEES OF LIQUOR AND/OR WINE FOR OFF-PREMISES CONSUMPTION AUTHORIZED TO APPLY FOR RETAIL FOOD STORE LICENSES. 1. A RETAIL LICENSEE OF LIQUOR AND/OR WINE FOR OFF-PREMISES CONSUMPTION SHALL BE AUTHORIZED TO APPLY FOR LICENSURE AS A RETAIL FOOD STORE. SUCH APPLI- CATION SHALL BE MADE IN THE FORM AND MANNER AS SET FORTH IN SUBDIVISION FIVE OF SECTION FIVE HUNDRED OF THE AGRICULTURE AND MARKETS LAW. 2. FOR PURPOSES OF THIS SECTION, "RETAIL FOOD STORE" SHALL HAVE THE SAME MEANING AS SET FORTH IN PARAGRAPH (B) OF SUBDIVISION ONE OF SECTION FIVE HUNDRED OF THE AGRICULTURE AND MARKETS LAW. § 2. The agriculture and markets law is amended by adding a new section 501 to read as follows: § 501. AUTHORIZATION TO ACCEPT APPLICATION FROM RETAIL LICENSEES OF LIQUOR AND/OR WINE FOR OFF-PREMISES CONSUMPTION FOR RETAIL FOOD STORE LICENSES. THE DEPARTMENT SHALL BE AUTHORIZED TO ACCEPT APPLICATIONS FROM RETAIL LICENSEES OF LIQUOR AND/OR WINE FOR OFF-PREMISES CONSUMPTION FOR A RETAIL FOOD STORE LICENSE IN ACCORDANCE WITH THE PROVISIONS OF SECTION ONE HUNDRED THIRTY-TWO OF THE ALCOHOLIC BEVERAGE CONTROL LAW. § 3. This act shall take effect on the sixtieth day after it shall have become a law. Effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
